"If the records are located at a later date, this decison will be reconsidered. If a different decision results, that decsion will be effective as of the date of the orginal claim."

Have these missing records turned up at all?

Service medical records for the period September 1993 to December 1997 could not be obtained for review.

If the records are located at a later date, this decison will be reconsidered.

If a different decision results, that decsion will be effective as of the date of the orginal claim.

Submit copies of them to the VA with copy of the letter that said they would reconsider and ask them to do that.

You can tell them how you feel these records warrant a higher rating and/or better EED.

Carlie just posted the exact reg- which I posted here for someone else this AM-

It is a reg that everyone should be aware of

Will this be a cue, or just file for reconsider because this was in 1998 and 1999.

I have since then gotten an increase to 50 percent for migraines, but they have mess me up on this.

I have been taken mildren, fional,darvcet-n, and iron tablets every since I enter the miltary.

Say This is a Reconsideration Request based on the enclosed letter they sent to you dated -whatever the date was Dec 1998 I think?-since the missing service records have now turned up and are enclosed.

Tell them you feel the enclosed medical evidence warrants a higher rating then that decision held and proper retroactive award for the migraines and then refer them to and enclose the regulation that Carlie posted link to.

They will consider the missing records and that might warrant a higher retro rating. It all depends n the Schedule of Ratings and how the new evidence matches up to the percentages.
