Decision Letter 'evidence' Questions

Rate this question

Hello all,

I have a couple of questions regarding RO decision letter evidence which does not seem to match up.

Decision letter evidence list - Feb 1998

Dates for several exams in 1997

Dates for several pulmonary function tests

They also provide a date in Feb 1998 and state "Claim considered based on all the evidence of record"

Decision letter evidence list - Mar 2000

Date of BVA remand in 1998

Dates for several exams in 1999

Outpatient treatment reports from August 1995 through December 1996

In 2000, the RO notes using records from several years prior. Is this correct or are they supposed to also include records continuing to the 1999 exams?

In 1999, the C&P doc requested PFT's, x-ray, and a CT scan,. Should these results be in the evidence list, like the PFTs from the 1998 decision letter?
