Why does the VA even have a disability program if they aren't going to play fair? I learned early that the VA played the game of LIFE by their own rules.And if they didn't have a rule for it, they made one up just for us and it would only be used once so that it wouldn't be considered the rule of Law.Last weekend, I received my medical records for my first 2 years in the sevice from the NPRC. Being in sports all my life, I was a suck up the pain kinda guy, so I didn't go a medical facility unless it was emergency in nature. So my records were a whole 12 pages long.(I create more nowadays in just one day) And to make me feel like one of the gang, two pages were missing.Would you believe those two pages just happen to be very important to my claim?(Silly me, you all have been at this for years and have heard this story a thousand times.) I know we have people from the VA who come here. Can someone explain to me why these records disappear. Are they paid to process claims or are they paid to sabotage claims. It happens so regularly, it just can't be fate.It has to be on purpose.The odds at them losing 2 pages out of 14 and those 2 pages being key to me getting disability must be HUGE. They did screwup and leave 1 page that may help me on my AO claim from FT Gordon .I don't remember my visit to the hospital there, but it occurred after 2 weekends of guard duty at one of the AO dump sites.It showed a strange rash, dizzyness, diarreaha, and a strange weakness. It was on a important medical document from Basic trainning.One of the page/pages missing was a 4 day stay at the base clinic/make do hospital for unknown reasons. This was key evidence again to my exposure to AO. The other document was a visit to mental health DR. In the letter they sent with my records, they said to call and give them special permission to send other misc records. Of course when I called them today, they had no clue to what the record clerk was talking about. So I told them what was missing and they said they would check again. (Some things have to be authorized twice by me makes no sense)I told them I was up against a 4/29 deadline, so hopefully they will be found.lol I can't believe that there isn't some hidden rule that says to deny deny deny! Lets keep the playing field fair and just decide things on the evidence. It's too late for me now, but I suggest if your thinking about filing a claim, get ALL your records first. Then file your your claim. By filing first they know what records to make disappear. They are the dealer in this card game and they decide what cards we get or don't get.Thanks for giving me a place to vent.Deadline date is approaching in 2 weeks so the end might be near for dealing with this silly game. Get my approval/denial and then to decide what to do. A hundred trees gave their life, just to save a few more government jobs.Was it worth it? We will see!! Mike

I am familiar with this OIG audit.There are plenty of OIG audits at the OIG web site.VA has policies ad finitum at the VA web site.

During the same time frame of these 'policies' and this IG audit in the late 1990s, the VA was still attempting to cover up my husband's wrongful death.(documented)There is STILL something they are covering up.I work on that whenever I have time.It affects not just me but other FTCAers.

When a VA practitioner is aware of any medical error they are supposed to do an Incident Report.Or get someone to write it up.

These incident reports are often put in the C file.In my C file was an incident report.Maybe the VA put an incident report in your file.It would be evidence that something went wrong.

The problem with it is that it was about an incident they blamed me for.

The report has nothing to do with the veteran- and everything to do with the fact I raised Hell about a major medication error.

Blame the messenger.(First they blamed the Post Office but I had witnesses so that didn't work) Their medication error could have killed another vet who lives on one hill over from me.There were conflicting VA opinions on whether the error caused my husbands death. But there was plenty of other evidence of malpractice so I didnt push this issue because they finally gave the other vet his meds.

If you hinge on what the VA 'should' do-as a claimant myself for most of the last 17 years-I learned I could never depend on what they "should' do and I sent evidence of malpractice along with my 1151 claim and SF 95 case when I filed them and continued to send evidence for the next 3 years until they awarded.

The OGC has yet to do what they 'should do' regarding a policy that is a Mandate that VA has agreed with in conjunction with the NPDB on FTCA settlements.

I have the agreement.

There are no exceptions to it.

By violating this agreement,( in other cases as well as mine) the VA can continue to employ and keep incompetent doctors who malpractice on veterans.

I hope you have a vet rep helping with the 1151 claim and any other claims you have.

Good Morning Berta and Hoppy!! Berta, from your post here and in another thread I can see that you probably see were I'm coming from and how I am approaching my claim. I'm gathering things like the two reports I attached in this thread for my NOD. I am also gathering evidence to shoot down their theories on how I got the Hep C. I have a medical study showing that internasal use of drugs cannot be a cause for getting Hep C like some people report.I'm definitely not gay and my marriage history shows that.lol And none of my wives filed sexual deviance or cheating on them as a cause for divorce. So many times in my medical history does it say no history of IV drug use. So that only leaves blood transfusion, dirty equipment or air jet gun injections as possible causes which I can concur each is possible.Timing on when disease showed up leads me to believe blood transfusion. Its coming up on 5 months since my C&P exam and around 240 days since claim was filed. So something is hanging them up.lol If they think I loaded them up on paperwork before,just deny me or lowball me and see how much I have saved up for them. And I backing up everything on CDs just in case they pull tricky dicky stuff on me.(Had to throw a little conspiracy theory in there for good reading)lol. Being in communications in the service,alot of secrets passed thru my patch panel. I got cocky after I got out of the service and when Senator Mark Hatfield came to the place where I worked, I shared a couple of them with him. After talking with his field people about some of the things people would like to know and others WOULD NOT want found out. I started seeing boogie men following me.lol After receiving a phone call stateing that "it would be a shame if something happen to your 2yr old son" I was suddenly struck by amnesia.lol This is the first time I've shared this with anybody.Anyway, I have always thought the Army was still trying to eliminate me without prejudice.lol I had to leave my beautiful beach home to come back to Idaho because Portland VA was giving me Oxycodone which I am very allergic to for over 2 years and they refused to change my prescription. My old PCP (yes the same one involved with my surgery) told me to move back and he would change my meds. And he lived up to his end of the deal.lol Hoppy, I think all us old timers have a story or two on how we challenged the VA system and LOST. lol I've got one shot at this disability thing. If I lose, next winter I will be just another homeless vet. Our current admin has promised me CHANGE!! Unfortunately everything has gone up in price, wages have been frozen and they forgot to leave me some CHANGE to live on.lol Already had to drop 4 prescriptions I couldn't afford. (pills aren't filling) So after a electricity rate increase of 95% last winter, won't be any funds for it this winter. So if I get disability I stay dry and if I lose, I lose it all. The lines I went through for the air gun in basic were literally hundreds lined up. The guys giving the injections were not nurses or doctors and they used paper towels to wipe off the blood. They did not wipe the guns either.

So far thank God I have not gotten Hep C

Veterans deserve real choice for their health care.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
