Deep Vein Thrombosis/vericose Veins/vascular Disease

Question

A good friend of mine has a current 10% for what the VA called anticagulation condition, unspecified.

What he had was Deep Vein Thrombosis, and now he has to take Coumadin every day. This occured in-service and is in his medical records for while he was in service. He also was diagnosed with, and obviously has vericose veins, and was also told during an ultrasound that he had vascular disease.

He is a Gulf War Veteran and all of these conditions happened after his deployment there.

Question: Any guesses to what his ratings would be

DVT Right leg-Constant swelling/Edema, Stasis pigmentation with ulcerations, Swelling never completely subsides even after a night in bed, Pain which also is never relieved.

Left leg- Swelling when sitting, standing, walking/ Stasis pigmentation/ Persistant pain, mostly relieved after a night in bed.

Vericose Veins Right leg-Clearly visible, aching/pain in right calf, Tingling sensation in lower leg and feet/

Vascular disease Right & Left leg-Pins & needles in lower legs and feet, aching feet, loss of hair.

Can these 3 ratings be present at the same time? Or is it a case of one, or 2 that can be combined?

If he can show that these conditions were present during service, and the VA had the records necessary to correctly rate the conditions (which were the same then as they are now) but only rated him at 10%, could this claim be requested to have an earlier effective date based on material evidince? He never appealed the rating. Or could this be a CUE?

If the VA did not have the records in their possesion in 2005 because they never attempted to get a copy of the records, but the Veteran listed where & when he was treated, what he was treated for, would this be a CUE?

I dont know the thrombosis ratings. but here is the varicose vein ratings. It does sound like he meets 100 percent criteria.

7120 Varicose veins:

With the following findings attributed to the effects of varicose veins: Massive board-like edema with constant pain at rest 100

Persistent edema or subcutaneous induration, stasis pigmentation or eczema, and persistent ulceration 60

Persistent edema and stasis pigmentation or eczema, with or without intermittent ulceration 40

Persistent edema, incompletely relieved by elevation of extremity, with or without beginning stasis pigmentation or eczema 20

Intermittent edema of extremity or aching and fatigue in leg after prolonged standing or walking, with symptoms relieved by elevation of extremity or compression hosiery 10

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

I need to find out if he can be rated for 2 of these 3 combined, or even all 3. With no pyramiding I don't think he can get all 3 rated, but I am hoping we can get 2 seperate ratings out of this.

I have Portal vein thrombosis, then Splenic vein thrombosis with ncreatizing pancreatitis. I had hypertention and intestinal disease on active duty along with hospitalization for gastritis. I also now had Glaucoma in the left eye and had catracts in both eyes, then the right eye the catracts were operated on, and the pancreas surgery wetn bad for a cyst, and infection set in..

As far as the thrombsis. yesterday I had a scope put down my my esophagos to see if the thrombosis was causing damaged and swelling and breagke of the viens in there... it turned out ok for now.

The thrombosis is hell.. and has caused me lots of grief and almost caused my life. It's a bad situtation.

the edema was very bad on active duty and was outrageously bad while hospitalized, I have suffered from edema for many, many years... I had to take diaretics and the va gave me a special electric bed to tillt to help drain fluid in my limbs..

not sure what my rating will be after my appeals go through, I am stlil awaiting the decision for the dro hearing last year...

Not in appeals, since I got 100%, and some of it was winning an 1151 negligence, which the VA turns out does not give ful benefits if you win 1151 negligence they squirm and legal loophhole you and your family out of many benefits, really crapp nasty bunch running the va benefits, they wil backstab and scre wyou even if you win you lose. May 2021.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
