OK..I'm at 21 months in waiting on TDIU decision. My claim went from development to rating phase just recently. Needless to say, my emotions went from inpatience to doubting phase at the same time.

In your people's opinion, especially the elders here, do you think my numerous appointments with the VAMC would hold any bearing with raters? All my appts are related to my SC disabilities. I also wonder if when your claim is in the rating phase do raters check for any new medical evidence that may have evolved recently? As in the last 2 weeks. My most recent appts clearly show my conditions worsening and I understand I can include that eviidence in a NOD or Reconsideration, BUT goodness, I hope it's considered now for obvious reasons.

I've been on Hadit a lot these past few days because my husband & sons are on vacation. This site has kept me occupied & focused. Thank you because I had really dreaded being alone for 2 weeks.

Yes, the raters lean more towards their own examiners opinion verses outside Dr's opinions.

Also re: the new evidence. Get a statement in your files stating you want the recent medical evidence considered with your claim. That is, if the exams where done at the VA. If not, get copies of the exams and submit it along with the statement.

I do not think that numerous appointments helps a claim only what's in them, I think that it really depends on the evidence and what the doctor writes in the progress reports. In my opinion raters do not request current medical reports unless told that there are new medical reports available. You can always go to the VAMC release of information office and request these records, make a copy for yourself and then mail a copy to the VARO certified return receipt and try to get them there before a final decision.

I suppose than I'll go to the DAV next week and get that statement included in my file. I appreciate the suggestion.

I got a 0% rating for cardiac artery disease. I appealed and got some more tests via the VA. I made sure the VA was aware of these new tests. I got an increase to 60%. So new VA medical evidence can help you a lot as long as the VA knows it exists.

Thanks..I'm actually looking fwd to sitting@DAV office for 3 hrs in order to tell them there's more evidence. I'll make sure to call 800# as well. Heck, i'll even get copies of Dr's reports and overnight them (w/receipt,of course) to RO. It's nice to have tasks and at least "feel" like i'm involved in the decision.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
