Question

Called the 1-800 # today and hit 0 and waited about 5 minutes before a gentleman came on. He immediately ask me for the normal information, and told him that I was sensitive seven, and he transferred me to a Lady that had the correct classification. She told me that my PTSD re-examination was still under review, and they were trying to determine if they need more evidence. Now, I had the C&P done back last Oct 2010. I just do not understand what other evidence they could need after the C&P. I do know that on my first C&P, the doctor gave me a GAF of 55, but I was in and out. The second Doctor gave me a GAF of 50, and gave a more detailed report of my suffering, and that I was unable to be employable. Could the VA just be stalling because the second examination was not what they wanted to see?

JMO Papa, I think it's one of their BS stall tactic's. Comeon! How long does it take to TRY to determine! Either they have the facts or don't. Don't tell me their just sitting there scratching their heads wondering. I'm sure you sent all available evidence and went thru 2 C&P exams, so what else could they possibly want from you. I think their just taking their sweet ass time with it. My second thought's on this stalling crap is, it's probably going in your favor, and their TRYING to figure a good lowball % for you.

You can always write a letter to the VA, stating that you want them to decide the claim with the evidence they have.

(The usual certified receipt required mail, etc., or deliver it in person, and get a date stamped copy.)

I think they see the second exam as being enough for 70% rating as opposed to the first exam which is more in line with 50%. If they grant you 70% then TDIU is almost a given. I think they are trying to figure out how to find a reason not to grant 70%. Knowing these bastards that is probably how they think. I would write them a letter and tell them to go with the evidence they have, but they may not do that since that does not fit their ideas. This is my opinion only.
