  • Can a 100 percent Disabled Veteran Work and Earn an Income?

    employment 2.jpeg

You’ve just been rated 100% disabled by the Veterans Affairs. After the excitement of finally having the rating you deserve wears off, you start asking questions. One of the first questions that you might ask is this: It’s a legitimate question – rare is the Veteran that finds themselves sitting on the couch eating bon-bons … Continue reading

Nehmir Claim

Question

I received a call from the San Diego Regional office that they had a made a decision on my IHD/Nehmir claim. She said by-law she could not tell me what the decision was and wanted to make sure they had the correct address to mail the letter to. She said to watch for the decision letter.

.I should know in about ten days the out come and will forward the decision to NVLSP for the records. Let pray it is the right decision from the start.

Has any one been contacted by the VA on the Nehmir claim by phone? Is this standard to call the Veteran when there Nehmir claim is complete.

Some vets here have been called and also given their retro Nehmer amounts over the phone.

More or less standard. Assuming that you have adequate medical records in your file proving the existence of IHD, and are a Nehmer class action member, (you obviously are), The award will go back with retro to the original claim date, or even an A/O related claim for another A/O presumptive, such as DMII, if your records showed that IHD existed at that time. (Under the "implied claim" rule, any claim that was submitted, and the records showed the existence of IHD at the time, may be used as a Nehmer date when all the other details are satisfied.)

While the VA caller was not allowed to tell you the details, with a little gentle prompting, additional useful information can be given. "You should be pleased" is one response that seems to be permitted.

A check or a direct deposit amount may be your first indication of the results, not the determination letter. For instance, my VARO seems to let the letters accumulate and mail them up to five days after the date on the letter, (end of week?) based upon the postmark vs letter dates.

In my case, about a hundred miles from the VARO, a letter mailed on Friday would usually arrive Tuesday or Wednesday of the following week. If you can access "E-Benefits" the information may be updated before the mail arrives. (Or Not, depending on the VARO)

If E-benefits is current, you can access the letters section, and print out a copy of an award, etc.

See good days ahead. Depending on how long ago you first filed, percentage awarded check could vary greatly. Since all this is on the way I know it's hard to wait. Even if you just filed few months ago would get one year back pay & I hope it's much more. Of Nehmer Case in my vet group think $3300 was least I remember. The one I love is $269,470. Cases at HADIT even more than that. Good luck, also good time to apply for free $10,000 life insurance.

    • Type 1 Diabetes recent onset!
I was diagnosed with Type 1 diabetes in September 2017 OUT OF NOWHERE.

i am a Navy Reservist and deployed in later 2009 to mid 2010 and again later 2014 to mid 2015; had a 2 year recall between those deployments.

Only healthcare received since commissioning in 2008 was from the Navy and no issues EVER.

insulin dependent and have dietary restrictions and in a non deployable status.

VA denied initial claim due to Type 1 not showing on active duty and now appealing.

Anyone with successful experience getting a rating with my circumstances?  I live in Upstate New York.

    • Agent Orange Kadena Afb Okinawa
I am looking for anyone who was on Kadena AFB, Okinawa or .Chanute AFB, IL. My dad was there from Oct. 68-April 70. He has ichemic heart disease, diabetes which has resulted in the amputation of his right leg below the knee and peripheral neuropathy. We were denied in 2002 AMVETS filed a claim on his behalf for heart condition, diabetes and back problems. I refiled in December 2011 and have just received the claim statements and medical release forms. I am familiar with filling out this paper work because my husband is a combat veteran of Iraqi Freedom. I have been reading articles from the Japan times and I am a member of the Agent Orange Okinawa facebook page. Another thing that helps make my dad's case is that he was on Chanute AFB, IL and it is on the EPA Superfund list and has PCBs/Pesticides and Dioxins/Furans listed as ground and water contaminants. I welcome any advice, tips or articles that I may have missed in my own research.

    • Appeal granted and closed.
My appeal was granted and closed on November 9.  I got an unofficial notification from the DAV on November 15 stating "appeal granted with an evaluation of 30%" which is great!  My question is this:  How long until I get the official notification from the va? Nothing on ebennies has updated since the appeal closed. Appeal is now in historical and just says complete and at originating va office. I understand no one knows va timelines to a tee but a general timeline would be great.  Thank you all! Hope you have a Merry Christmas!

Edit:  This was my first time appealing and it was a VBA grant.
