Question

If any of you know of any widow or surviving adult children of any Vietnam incountry veteran -who might be eligible for potential retroactive payments under the Nehmer Class action case, please advise them to file a claim with the VA ASAP.

If they were denied DIC in the past but any one of the 3 new AO presumptives appears on their spouses death certificate and/or they could potentially be eligible, if they already get DIC now, for any accrued awards under the new AO regs, they should certainly file a new claim if they have not heard from the VA at all since August 2010.

If they did receive the formal Nehmer letter, they should follow up on it by writing to the VA requesting a status and asking that their case be considered for any potential accrued benefits as well as for DIC.

They should also email NVLSP at their AO link which I bumped up in the AO forum.

This request is from Rick Spataro, NVLSP , Managing Attorney, Nehmer Lawsuit Division

The Nehmer Training Guide in the link I just bumped up describes who is a potential Nehmer class action member.
