Social Security Disibility Process

Question

I have a several questions concerning the SSDI process. I am rated at 80 percent by the VA for the following:

Sleep Apena. 50

PTSD with depression 30

Gerd 10

Right knee condition 10

Tinnitus 10

Hypertension 0 sc

Hearing loss 0

Total 80 pc

I Filed the above conditions along with chronic back pain, neuropathy and diabetes with SSA. I was denied three times. No gainful employment in over a year. Claim has been denied by SSA three times.. I now have a lawyer with a hearing scheduled for March...Does anyone know how long after hearing does it take to be notified? I m taking 15 med per day for my cconditions..feel bad most of the time...letter says occupational specialist will be there via video...Please Advise...

I'm sorry for the runaround you're getting from SSDI; that's why there's a whole industry based on getting worker bees the benefits they've been promised their whole lives.

I'm hoping you'll get a positive resolution soon after your hearing.

Best bet is strong evidence that you cannot perform work of any kind.

We may be able to give further assistance if you post the Reason for Denial.

Generally they notify you, of a decision, within 60-90 days. Some judges having enough evidence, at the hearing, and can let you know immediately, if you are approved. They will never tell you of a denial at the hearing, fearing you could retaliate, immediately. It then can take another 60-90days to get paid. Thirty percent for PTSD is kinda low for a rating. I'd suggest putting in for an increase, or if it's been less than a yr, since the 30% decision, appealing it. jmo

Thanks to all for your response...I have several claims on appeal..one is for an increase on the PTSD with depression. I felt the initial decision was too low...I started out with 40 pct at retirement from the Corps...My health has decreased significantly over the past five years.. I am unable to work constant pain and the side effects from the medications along with constant fatigue....My claim for IU was also denied large in part due to Dotors saying I could do light sedentary work. I have worked as a Barber but I am not able to stand and do that kind of work...

What should I expect and the hearing...I have a lawyer ..will he do all the talkin? Will the ALJ give me an opportunity to tell him what one of my days is like? The pain in my hand and feet is excruciating (bilateral neuropathy)

SSD is much like va but a lot easier. The waiting and being denied the worst. Id say afetr 3 denials youre due to be approved even with out an attorney. WITH an attorney, and being unemployed due to inability for over a year, your due for an approval. Id put money on it, PARTICULARLY with an attorney. You can quote me on that! Id say good luck, but ya dont need it, th hardest parts are by and large over. JMO, but thats more often than not good enuff! Or I dont give it! Mystic

I think, based on what you've stated, you'll win. The lawyer will take the lead. He/she may or may not call on you to testify, as to your daily life, what you can and cannot do, levels of pain, side effects/affects of meds, and anything else that may be needed. It's best to be truthful!!! You'll be sworn in for all testimony. The ALJ may or may not ask you questions, for any clarifications, he/she may need. It is best to describe your worse day(s). Good luck, altho I doubt you'll need it but ya never know. jmo
