Waco Va Update

I just found out that the VARO in Waco is currently working on claims for December 2010 that are in the raters hands. This is what is called the decision phase right? I was there yesterday to speak with them about my e-benefits setup and was able to get this. I was told that since I initially claimed it in May of 2011 that it should not be much more time before it is resolved. I just thought of a question for the Hadit veterans. I went in an was due to have an orthopedic evaluation for surgery. I advised the physicians assistant that I was at a pain level of 4. He then had me get up and slapped the top of my shoulder. He then yanked my shoulder well above my ROM causing me intense pain. When I complained he ended the appointment and stated that I would not let him work on me. I told him that is true unless he can be more gentle. He then opened the door and basically put me out. I went to the patient advocacy area and made a formal complaint but I feel as if I am being swept under the rug. I went from a 4 to an 8 due to this and had to wait in the hospital for about an hour for my meds to kick in. I then had to wait in the parking lot to ensure that I didnt have side effects that would hinder my driving. Is there any way that I can let someone know that is in a higher position that the patient advocates? I dont want anyone to have to deal with what I delt with. This was the Dallas VA medical hospital clinic 7. I will list the pa's name if you guys want to avoid this gentleman.

My claim at Waco was made in July of 2010 so the VARO is lying. They are way behind and mostly cherry picking easy claims to meet numbers.

As far as that Doc I would go to Administration and complain to them. Most of the Docs at VA Hospitals protect each other.

Veterans deserve real choice for their health care.

\What are you claiming disability for? On your reply I did hesitate to even send this due to someone stating never listen to what "Peggy" tells you. I did actually receive this information from VBA in Dallas when I experienced that issue with the Doctor. He did state that all Agent Orange claims have been dealt with and now they are working on the backlog. Now as far as this Physicians assistant. I really want to move this up the chain of command in the hospital. Is there anyone that can help me figure out where to start. We risk our life for love of country and then are subject to issues like this. I refuse to let this go.

I requested that I be given a higher S rating. As it stands now I was rated S for Housebound due to agoraphobia. I meet the criteria listed for a higher rating.

All I am really saying is Waco usually moves a lot slower than they tell people.

Pete you just hit siomething that really made me think. I too sir have been diagnosed with Agoraphobia by the Va and I did NOT claim this. I was on meds consisting of Paxil initially and then Zoloft. I stopped taking my meds due to them making me very very combative. I go to work and go home. Forget about movie theaters and WalMarts. The Paxil made me feel like a walking zombie while the Zoloft made me EXTREMELY irritable. I had a very bad experience with an E6 that had my name engraved on a m16 round for display. I think this is where I started really being conscious of my surroundings. You think that I should claim it? In addition, I am confused about something that either you, Berta, or Carlie can help with. I have an appointment to return to the VA for ortho surgery evail. Now all of a sudden I have to also go for a c&p exam two days before. I just received the C&p appointment yesterday. Can someone chime in on possible reasons for a second C&P exam before my ortho eval? Thaks guys.

Nevermind pete. I just was able to check ebenefits due to being set up now and i see myself back in the gathering of evidence phase. Will post on a new topic for carlie and berta.

Although you show symptoms of agoraphobia it must be diagnosed my an MD to make any headway with the VA. The fact that you can manage to get to work and back does not mean that you don't have it

Good Luck

If I were you I would talk about it with you shrink or whoever you see at the VA.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1.       Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
