Good luck on your test . I just thought of a valid question. Last c- p exam they completely ignored the minimum rating for a hip replacement. They rated soley off of the range of motion for the hip guide . During the exam next week how do I make sure that does not happen again . I mean the minimum rating for a replacement is 30 percent. Yet they awarded 10 percent only . Based off range of motion . If during the exam they start doing range of motion do I assume I am going to get screwed or can I just ask how they are going to rate the twin replacements

Thats is great. If the VA does the C & P ( and not QTC) ask for a copy of the results right away.

On remand I got a posthumous C & P done at my local VAMC ( for my DMII AO death claim 2003)

I got a copy right away and knocked it done and sent my rebuttal to the BVA.( and a copy to the C & P doc) HAHA

I proved it was too speculative. BVA agreed and awarded on the 3 IMos I had (overcoming 2 VA endocrinology opinions)

At first I felt this was a BVA "fishing expedition".... many other hardcore claimants here know what I mean.

But the remand called for a Cardio opinion and I got a PA opinion.

Nothing wrong with PAs but I knew more about cardiology and endocrinology then he did.

You can send evidence to the BVA , when on remand, at any time prior to the day they make their decision.

I sent them copies of the evidence my VARO had completely ignored.

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.

Thanks I was not sure if it was within my right to ask right away what they were checking and what the rating would be . It seems they ignore the obvious. It would seem simple , they verify the two replacements and I am done . But if they start range of motion I would get worried
