Wow - Va Calls A Cue During My Administrative Review

Rate this question

carlie

Question

Happy Birthday to me : - )

An administrative review was done on my BVA decision from Oct 2011.

DECISION

The effective date of assigned for grant of Special Monthly Compensation

is a clear and unmistakable error. The effective date is changed from

October 29,2008 to March 23,2004.

EVIDENCE

Rating Decision, and all evidence contained therein, dated October 26, 2011.

The deposit has already been made and it's a really great birthday present.

I'm glad THEY caught THEIR error.

Carlie passed away in November 2015 she is missed.

Congratulations!! It is unfortunate that we ever used illegitimate as a legal way to describe a child. Planning and persistance wins again (eventually)!

I really enjoyed reading your timeline. I started this process in 1977. I was SC in 1977 or early 78. It was sooo difficult in the early years as there was little to no support and a person could not hire an attorney if needed. Finding advice prior to the internet was almost impossible. I was lucky to have a VSO speak to me before I was discharged at Bethesda. He advised me so I knew who to see when I arrived in my home town and what to expect. At that time the Red Cross had VSO and mine was a strong, well-spoken female who wrote some well-worded documents to get my claim going. I worked with her for a number of years before the Red Cross dropped that service.

"Yet the VA raters are well paid and trained not to make errors ,but they do, and they hope we will not discover their errors (that almost always are at the expense of veterans)"

I don't think a lot of the decisions are "errors." I think they are tricks.

Think Outside the Box!
