Was going to post as a follow on to the thread I started under claims but figured more appropriate under "Success"

Filed a claim for "reconsideration" and "new items" 24 Jan 2012. QTC exam 8 Nov 2013 and received the big manila envelope today.

Obstructive sleep apnea 50% effective 18 April 2012

Tinnitus w/hearing loss 10%

scars- bilateral lower leg 10%

Degenerative Joint 10% (increase from 0%)

Of note is I retired Oct 2004, diagnosed with PTSD June 2009 and Sleep apnea Jan 2010

Question: Sleep Apnea

Sept 2010 Original claim

April 2011 Decision letter denied sleep apnea.

Feb 2012 filed for reconsideration .

shouldn't effective date have gone back to original date of claim Sept 2010 vice effective date Apr 2013??

Final comments:

still have to confer with Dr B to discuss challenging decisions of other items.

For the sleep apnea it was presented as secondary to the PTSD. Originally submitted as a "stand alone" and was denied. Food for thought--

That sounds like a CUE error.

But as PR said , we need to read the VA's actual decision.

What is the rating they gave for the PTSD?

Good. Hopefully the retro will help to become a good investment into an IMO from him.

Are you still working? Is the 90% what you have now, after the manila envelope came?

By saying you "retired" do you mean you are a 'lifer'?

You did very well on the Recon Request!!!!!

That type of request , that we have discussed here, Can work ...if the VA will actually read it.....

A recon request does NOT stop the NOD deadline clock however.

Can you tell us the actual breakdown of the 90%?
