How Long Is Too Long For "expeditious Treatment" From A Remand Order?

Rate this question

Question

I know I'm whining a bit, so please forgive me. My appeal was remanded in April, 2013. I still have not yet received a C&P as directed by the remand order from my BVA hearing. At what point do I start raising he11? Sorry, just needed to vent.

Limbo is status quo for the VARO.

1 year, 1 month, 11 days from BVA remand and still waiting. I wonder if this is a sign??

I advocate sending them a "reminder" that the expeditious treatment of the claim is being ignored via the IRIS system. More has been accomplished with this underutilized tool that I can tell you. Sometimes a bottle in the ocean is all it takes to spur them to respond. A Writ at this stage would be a horrific waste of $50 and gain you nothing. The definition of expeditious at the CAVC is within 18 months. They kowtow to the VA in spite of what is said to the contrary. However, when it gets out to two years, they lose patience and a Writ will light the fire.

Send them a letter that if decision is not made in 30 days you will contact Chairman Miller and file a writ of mandamus.

Good Luck

I was waiting on my FDC to happen since June 2013. I finally wrote my congresswoman a letter and within a few weeks I was scheduled for a C&P exam after nothing for almost a year. Maybe a coincidence but I doubt it. Congressmen can get action if they want to just by asking the question. I usually don't bother, but waiting a year on a FDC claim is a joke. I don't even see why I am getting a C&P since all the information was in my VA medical records.
