Requesting A New C&p

Question

Is it possible to request a new C&P? I had one on 4/25/14, it lasted less than 1/2 hour and my claim for PAD secondary to my SC DMII was denied based on what the C&P Dr. wrote even though I had 2 Drs. who are treating me stated it was connected.

Has anyone very tried to get a new C&P, if so how do you do it and with whom?

Are you and your VSO absolutely certain that VA was correct in throwing out your 2 doctors statements?

As I mentioned the letters were not fully developed

I have a few questions on this. I would hate to see you do all the work of getting IMO or IME if not absolutely necessary...

#1 Did the 2 doctors statements get submitted as part of your claim?

yes

#2 If so, did the VA denial letter list them as "evidence" in the Evidence section of the denial letter?

Yes

#3 If VA stated that the IMO or IMEs were not valid, what exactly did VA say the reasons were? If they throw out your medical evidence, by law, they have to give a legitimate reason why.

No supporting evidence to support a nexus for SC PAD secondary to DMII

#4 Are you able to copy and paste your denial letter here?

Not yet, I will try

I got a copy while I was up at the Saginaw VA Hospital. I filed out a form at the medical records Dept. and the clerk printed it out.

they will send it to the VAMC records center in abt 2 weeks, you have to try and get it before they send it to the RO. if the CP exam was done at a VAMC, then it is permanant record and u can get a copy anytime, just go to the release of info office at the hospital, and they will print it. I advise getting a copy of your records abt every 3 months. I have every document from the day I started going to the va, to my last appt. It comes in very handy., when I recenty filed for SS, I brought the whole med file to the lawyer and told ghim to copy what he wanted but do not let any originals leave his building.

also tell them you want all doctors notes. xrays, ct scans, MRIS., ect. They put mine on a CD that is viewable on any up to date puter.

Also ask your service officer this.... ask him if he knows who is buried in Grants grave? If he says he doesnt know, fire him or her.

Grant is buried in Grants grave, this will just tell you if they have any damned common sense.

To clarify, neither of your 2 doctor statements said the DMII had caused the PAD?

If not, then yes you will need to proceed with getting IMEs.

Sorry, but your VSO sounds like an idiot! Getting a proper nexus statement is the only reason to submit a doctor statement for a new contention. This is VA Claims 101...

There a book you might want to read. It's called the Veterans Benefit Manual. It will help you more than any VSO.
