RUREADY Posted May 14, 2015 Share Posted May 14, 2015 If you adopt a child an apply for education benefits for the child at what age is it before benefits expired. I see some say it has to be before they turn 18 and I seen its up to 23 years old. RUREADY Posted May 15, 2015 Author Share Posted May 15, 2015 38 CFR 3.57 is a bit confusing by first stating you have to adopt before they turn 18 then you go down to section 2 and it says this (2) For the purposes of determining entitlement of benefits based on a child's school attendance, the term child of the veteran also includes the following unmarried persons: (i) A person who was adopted by the veteran between the ages of 18 and 23 years. (ii) A person who became a stepchild of the veteran between the ages of 18 and 23 years and who is a member of the veteran's household or was a member of the veteran's household at the time of the veteran's death. maybe an attorney is the right way to get the answer for this Link to comment Share on other sites More sharing options...
