Nod Or Request For Increase

Question

I am SC 0% for my left ankle and it's been a few months since the rating. I was seen by an ankle specialist, had MRI done and he recommended surgery to repair the damage. Now that I have new evidence, should I submit the new evidence and request an increase or should I submit a NOD?

It comes down to a question, do you want the retro or do you want to avoid the appeal wait time.

If you want the retro, the go with the NOD, if you want it to be more quickly (relative term) adjudicated go with a request for increase, just make sure you have all your ducks in a row, get a good ime, medical records, lay statements, get it all together.

personally i hate giving them a 'win' so i have gone with the NOD, even if i know it will take longer.

70% - PTSD

->50% - OSA (Secondary to PTSD)

30% - Bilateral Pes Planus w/Plantar Fasciitis

30% - Migraines

10% - Tinnitus

20% - Back

0% - bilateral shin splints

Sorry to hear of your issues, and I totally agree with USMC on this one. I would personally have the Surgery then submit for the Temporary 100% along with the Increase. Good luck and keep us posted

Also if you do decide to file for an increase instead, go on ebenefits today and do that now so you lock down you date for retro, or just do it now regardless so if you do decided to wiht increase instead of nod then its locked down, just start it but dont finish it and its saved and open for one year.

70% - PTSD
