One month and counting since DRO hearing - Question though...

Question

Well yesterday marked one month since my DRO review hearing.  I was told that it could be months.  So I am prepared to sit this out.

I do have a question though, is it true that they have to wait at least 60 days to ensure I do not submit any other evidence?  If that is the case, can I let them know by submitting a VA21-4138 stating I have nothing further to submit?  My DRO hearing went well and I provided everything at the hearing that I need to provide.

Does that ''decide my claim'' truly work?

I hear pros &cons about that.

Gastone Navy4life had a face to face DRO Hearing at her RO.

She mention the Hearing went pretty good.

I am not an Attorney or VSO, any advice I provide is not to be construed as legal advice, therefore not to be held out for liable BUCK!!!

Most of the time, VA will send you a letter asking you if you have any more evidence, and give you time to respond.  However, you can sign and send a form, with this letter, that you have no more evidence, if that is the case.

You can also go on ebenfits and click "decide my claim"...this means pretty much the same thing...that you are done submitting evidence.

Maybe on a regular claim or FDC claim but not on an appeal. I can't do either of those on my appeal.

I used the "decide my claim" for an FDC claim last year and it worked for me!

Just an update, my FDC completed yesterday, which was lightening fast for a claim with the VA!!!  Now I am just waiting on my NOD.  Hopefully the 60 days the DRO hearing officer stated it would take, is what it does take.  That would mean by the end of this month.

And that would be wonderful!

I think you have done a great job with all this....now let's see if the VA does a great job too.

GRADUATE ! Nov 2nd 2007 American Military University !

When thousands of Americans faced annihilation in the 1800s Chief

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.
