gulf war illness

I'm interested in filling a gulf war illness claim , my question is do you think it worthwhile, I have the symptoms that are required for the claim , but some of the fall into my ptsd symptoms which I all ready receive compensation for .

  if I file gwi , will they try to reduce my ptsd rating.  all I read is so many gulf war claims are denied . I don't want to fill and have it denied and have them turn around and start messing with my ptsd claim . Any thoughts?

You indicate your currently 10% SC, for PTSD, really? I've never seen a 10% PTSD SC rating over the past 8 years but if you say so, I guess.

Your not a Dr., let your VA or Private Medical Specialist, do the DXing of what you have or don't have. Are all your current Med Records with your VMC?

If you have any non-VA Med records, corroborating your "GFI" symptoms, get copies of everything. Attach as Pdf's to your "GFI" Comp Claim. Be sure to file this New Claim as a FDC (Fully Developed Claim), do it yourself on your E-Ben Account site. Just starting the E-Ben On-Line app will lock in your Retro Date. Start it today, you'll have 12 months to finish & hit the Submit Button. You should be able to get everything together in day or so (Maybe longer) copy and attach as Pdf's, hit the Submit, then sit back and try to relax.

FDC Decisions seem to move at Warp Speed, when compared to VA Reg Axx Comp Claims. Not unusual for an FDC Decision to be completed in less than 6 months, whereas Reg Axx can take 18mos to 2+ years, depending on their complexity.

My rating for ptsd  is 30%,and hearing is 10 %

What I'm asking is since a lot of ptsd symptoms are crossover in gwi symptoms will they still see them as gwi symptoms as well , such as chronic pain , sleep issues, joint pain , migraine, 

I have symptoms documented through time but are only treated with medication both through va and private,

  I know the deadline is coming up so I'm on the fence with filing .

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Martinez v. McDonough (2023)

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
