UPDATE ON NOD FOR TDIU

Question

I apologize for starting a new topic on this,  I'm fairly certain I started a topic on the NOD for tdiu that I have pending but couldn't remember which forum I posted it in or the title.  I have a NOD that's at 450 days currently (average for completion at my RO is 291), long story short is I did request a DRO HEARING,  and I submitted new and material evidence in the form of a Voc Rehab letter finding me to be permanently unemployable. I received a call today from my VARO,  from a supervisor letting me know a decision had been reached and I would receive it in the mail within a couple of weeks. I asked him if I needed to come in for a hearing and he stated,  oh,  no.  My question is,  since I did request the hearing and I did submit new and material evidence,  is it reasonable to expect a grant on the tdiu,  since they did not schedule me for a hearing. I know nothing is ever certain, I did have overwhelming evidence but I was not sure if they must schedule you for a DRO hearing if they are going to deny,  (as long as you have submitted new and material evidence), or if them making the decision without scheduling the hearing is possible good news.  I thank everyone in advance for any insight

Called my RO today and none of the numbers I tried answered,  but I also spoke to Peggy and the gentleman I talked to said it looks like the holdup is attorneys fees.  He said its probable my DRO didn't realize I had an attorney,  and if that's the case,  that's great news. I was considering attempting to drive to my RO,  but with my lupus condition currently flared up there's no way I can handle the four hour round trip,  so I'll continue to wait and keep everyone updated.

their waiting to pay you the million$ back pay  and they seem to take their ever loving time about it.

R3dneck, thanks for the info,  mine was a DRO decision this time,  so not at the BVA,  but I appreciate the help.  It's still a good number to have.  Buck,  thank you for the encouragement, I'm going to wait until next week and give them a call back.  At least the rating decision has been made,  I just wish I knew if it was p&t so I could let my daughter in college know something,  but it shouldn't be too much longer.  I'll keep everyone updated

I hope you get the p&t too,  cross fingers for ya  lets all hope its maybe even better than what you expected

flores97 - I had a similar experience - I had the grant, w/o a hearing , I got the call and s told I  was approved - Never got a packet.... in the mail.... had local VA print out my letter. :)
