Another PTSD exam? Already 70% SC'd! What!?

Hi All,

 

Filed a claim in 2016 for a few increases and a secondary claim for Agoraphobia.

I am already rated 70% for PTSD that includes panic attacks, anxiety, and depression. 

My claim went to gathering of evidence from Prep for decision. I had 2 other exams for this claim, one for my testicles and the other for hearing. It appears they forgot the 3rd C&P exam for agoraphobia?

After speaking with the VA, they told me I have another exam regarding PTSD. Does anyone think because I asked for agoraphobia as a secondary condition to PTSD is why they're requesting another C&P? I was SC'd in 2010 for PTSD.

Being awarded IU   you can't be working at all.... your S.C. DISABILITY is why you can't work! PERIOD.

  You need a Dr to give his opinion why your disability keeps you from working, statements from family & friends that have known you over the years and medical evidence of your servere S.C.Disability & letter from VA Voc-Rehab stating your unfeasible to retrain due to your s.c. disability...you need these things  as evidence for the rater to decide rather or not you meet the criteria for IU.

IF you have not applied for VA Voc-Rehab  I suggest you do so... & check with your Dr  VA or Private about getting you favorable letter FOR his opinion after examining you and reading your medical records..this is called a IMO ( Independent Medical Opinion.).or IME (Independent Medical Exam)

You need to muster up all the favorable evidence to show why you can't work and it needs to be because of your S.C. Disability.   even if the Dr can show when your severe S.C. Disability first arose and use that date for your Early effective date.

Medical Evidence is your best friend to win your claims.

However if you apply for increase and the increase warrants  IU then they should infer the IU,( So watch that carefully) but you may get a 100%rating too  so these two ratings  pay the same & same benefits.

some say the 100%rating is better, I defer I think the IU is a better rating b/c 100% is subject for re-exams...the IU is too but they tend to leave the IU Vets alone as for as re-exams..but the VA Can call any of us in for a exam under 20 years.

if your 80%S.C. Now  and get a 70%PTSD Rating  according to VA Math that is a 94%rating which would render you a 90% combined rating  that is enough to use the extra schedular rating system for IU, 

Now if you were to get a 100 % PTSD Rating  that would boosts you to 100 % & plus you would meet the SMC Criteria.  SMC-S H.B. another347 Month with spouse on top of the IU  Rating..

That's where I'm kind of in limbo! I may be increased on my testicular issues which would put me at 100%.

IU is a possibility, but even with low pay, it kind of helps me stay somewhat functional. If that makes any sense.

At this point, I'm waiting for anothe PTSD exam and then I should have a decision on my claim.

I'm 90% combined now.

oh I thought you were 80% but never the less at 90% you will need a 100%PTSD Rating to meet the SMC Criteria!

90% plus 70& is a 97% which is a 100% rating  but you need to be 60%above the 100% to meet the SMC Criteria.

After a 100%rating  and all your other ratings add up to 60% then depends on the severity of your disability's for the SMC

SMC is usually meet when the veteran has a 100%disability and a separate S.C. Diability of 60% or higher to meet the SMC Criteria.
