Average wait time for an expedited BVA Appeal decision

I'm hoping that someone can help me with at least an estimate on how long it takes a VLJ at the BVA to complete a decision on an appeal that has been expedited.  This is not a remand.  I was told by my attorney that my appeal was assigned to a VLJ back on 12/15/17 and that the Board approved our motion to expedite.  I also have received a letter from the BVA stating that they did grant our motion to expedite but the letter just now came in the mail but my attorney knew back in December that the request to expedite was approved because he called the Board. 

My question is...how long is the average wait time for an expedited appeal decision from a VLJ once they start working on it?  Since there seems to be a significant delay in the paperwork and updating the eBenefits website...I'm wondering if there's a delay in the BVA updating VACOLS as well (which is the database where my attorney checks for movement on my appeal).  If anyone has had experience with this, I would greatly appreciate any estimation of wait time.  Thank you in advance for your help and I'm praying for all of my fellow brothers and sisters that you receive a victorious decision soon as well.  God bless each one of you!

open link

look to right - excel link - click on that link

then as the spread sheet comes up - click on tab at the bottom TA

see if this information is helpful. - It has a generalized time line for categories.

Hi L,

Thank you so much for your fast reply!  I went to the page by using the link but I didn't see any TA tab at the bottom and all of the info on that page is for claims but everyone who has been through the appeals process has told me that appeals take longer to decide so I didn't want to allow shorter time frames for claims get my hopes up for an appeal decision and then be even more disappointed.  I contacted the Ombudsman via email and their reply has proven to be inaccurate as well because they told me that we were still in a stack waiting for approval of our request to expedite.  It used to be that when you called the 800-827-1000 number, they could give you an estimated date of completion but the last time I called which was months ago, she said that there was nothing on her screen that showed one.  It's too bad that the VA doesn't have a page like the one you sent me but for Appeals instead of Claims.  Thank you again for taking the time to reply...I appreciate any insight at all and I hope yours is resolved soon, too!

@Disciple -  I think I missed a step in my directions ....  Once you see the EXCEL - icon - right hand side ..

scroll down to the bottom of the page - it has the yearly quarters sectioned off -

go to the most recent quarter- spread sheet

click on the date

once the spread sheet opens - look down at the bottom tabs

Traditional Aggregate... TA 

I believe the appeals categories is a part of this page..... 

I sometimes think faster than I type- missing steps.... sheesh.   sorry

Thanks L!  I was able to view the spreadsheet but unfortunately, it didn't provide what I was looking for.  Oh well...I suppose this is a massive lesson in patience.  Thank you again for taking the time to send me the link and I wish you all the best in your dealings with the VA!

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
