So if you were notified that you were awarded Chapter 35 benefits in 2004 and the benefits were retro to 2001 the ten years to use that benefit would begin in 2004 when you first learned that you were entitled and not 2001?

You have to make an election for that to happen John

John, you would have a choice of 2001 or 2004, whichever would be more advantagous to you.
