Retroactive Chapter 35 Benefits

I was awarded p&t January 5th 2007 with an effective date of August 29, 2006. Can my wife get retroactive chapter 35 benefits back to August 29th?

If I read it right you should have had 10 yrs from the date of his death or 10 yrs from the notice, 3 yrs later. Your choice.

So if you were notified that you were awarded Chapter 35 benefits in 2004 and the benefits were retro to 2001 the ten years to use that benefit would begin in 2004 when you first learned that you were entitled and not 2001?

John, you would have a choice of 2001 or 2004, whichever would be more advantagous to you.
