Claiming a presumptive without knowing it

Rate this question

Carl the Engineer

Question

OK, been reading other post tonight and stumble on this question, which brokensoldier244 may have answered.

I claimed a couple things secondary to a service connected condition.

Now, I see, that what I have is on the Gulf War presumptive list.

Question.  When the VA raters see a disability that correlates to the Veteran's time in service, do they put 2 and 2 together, or do you have to show them connection?

Thoughts,

Hamslice

I will find out here shortly..

Both. We look for it and so do they. But Ctrl f doesn’t work on everything and we’re still eyeballing hundreds of pages a day in typed but scanned documents ( doesn’t appear as text when searched for) or hand scrawled op reports, sick call slips, abbreviations that aren’t standardized, etc.

that being said, we can’t infer a disability and then deny it either. If it’s inferred it’s because a positive grant can be made, even if it’s 0%.
