Good Afternoon, 

I did something stupid. I had appts with QTC via the VA. I went to both appts. It was for allergic rhinitis. Every six months they would do an exam for check. When I went in for the appt I was so watery eyed and nose full of allergies that I was miserable. Everytime I go for appts at QTC the lady examiners are so very rude and condensing. Well, on the Ebenefits. VA.Gov website they sometimes send emails asking about your visit. I usually never complain but just take their terrible attitudes in stride as best I can. This last particular visit was do awful I cried going home from the rudeness and once an email was prompted to discuss it I reported the examiner. My stress level was so high I just couldn't condone it that time. 

Once I wrote the letter, the reprisals and retaliation came swiftly.  I had pissed several examiners off. 

Of course they're using their power to reverse my claim. 

Are you able to recommend a Lawyer or VSO for help?

Hi Maryk welcome to Hadit. If you have been diagnosed and have a VA disability for 5 years or more you have some protections. The VA can't reduce your benefits/disability rating based on one exam. Hopefully you have med records that document your continued symptoms. There are several lawyers you can contact and don't be discouraged if you don't connect at first; keep trying. Some noriable (in no particular order) are CC&K, Perkins Studdard, Hill & Ponton,Veterans Law group, Walsh and Woods and Woods. You also may want to document, in detail, what happend and sent a copy to the director of your VA Health center to be on record of their poor subcontractor.

   Welcome to hadit you are at the right place.  Your c and p examiner does not have the authority to reduce your rating.  

"If" you get a proposed rating reduction, which must happen before you actually get reduced, you can mention that the examiners are appearing to retaliate, because you reported poor service.  

    For right now, dont do anything.  Most of the time, this will blow over like the weather.  Its rare that, by reporting poor service, you can suffer "long term" retaliation.  Most of the time, yea, they get mad, but they dont really have time, nor desire to effect a serious retaliation effort based on "1" negative letter.  

     Example:  Lets say you got poor service in your favorite resteraunt. ...3 years ago.   Well, you may avoid that waitress, but, chances are, she may not even still be there, and, even if she is, she may not remember the incident, or best is she may have experienced forgiveness. (best).  

     You should do so likewise:  (Forgive).  One pastor called it "toxic unforgiveness" when we hold a grudge.  Remember, that unforgiveness eats at YOU, and the person responsible probably thinks about it very little, if at all.  Its sort of like taking a poison pill, and expecting that pill will affect the enemy.  

      If you experienced poor service, Im quite ok with reporting it.  But, then forget it.  Personally, I usually wait to see if the poor servvice re occurs, or, if it was blatent, before I report it.  I give them the benefit of the doubt, which you probably want and deserve also.  This person may have had a very bad day.  I know I have, and took it out on others who did not deserve it, simply because they were there.  

     I have never, ever regretted it when I forgave others, but have deeply regretted it when I let it fester and consume me with hate.  With some help from above, I do not hate anyone, nor do I harbor any toxic unforgiveness.  At my age, I dont need to deliberately put any more toxins in my body.  I have enough toxins in there already, from the environment, and some mistakes I made in the past.

Ok why would a veteran let a bad comp exam experience go.

Why would a veteran do nothing when the va used the exam against his/her claim.

That would make no sense.

Like I say ppl better start put and upload and mailing things about these exams.

Because you will not get a copy before it is used against you.

We all can see there are more exams been order these days.

And more veterans are having there rating reduce.

And like I say if it's a bva decision you have 120 days from the date of the letter.

And with not getting letters for 30 days.

You might have 90 days.

Maybe for the Veterans personal mental health?  Maybe because of retaliation potential?  Or maybe they just dont like fighting and arguing all the time?

    We have plenty of chronic complainers.  Pretty much none of them fixed VA.  But, maybe someone who was nice and kind, and made a suggestion..maybe some employee thought, "oh what a nice idea from that nice Vet".  

     People dont want to be forced to do anything, and that applies to VA employees.  Its often better to ask nicely.  I know I dont want to be forced to wear a mask or be forced to get a vaccine..EVEN IF I thought that was a good idea.

Well  what mess with my mental health is anyone play with my income.

So if I feel they are yes I am put something in my record about it.

I don't just let it go

Guys just be on the lookout for these va comp exam games. We can all see them from the many post now that come about comp exams.

Crazy part I doesn't effect me but I don't like to see other veterans get play by there new comp exam system.

Now I could be wrong but they told me my exam were ace exam the day of the exam the doctor canceled it.

Lhi and stated they can't do the exam with out me in person.

I denied wrote I am 25 year tdiu and have a 25 year record for the rater to address.

I am not tell anyone to follow this I do it because I am protected denied the claim I will appeal to court.

Well needless to say the remand for the loss of use was withdraw by the ro and they just never gave me a decision.

It will remain in appeal status until I have the court address it again. Smh

I feel you have to press the va or you will be on a hamster wheel for many years.

This is just my opinion.
