Second Signature

Question

i called the 1-800 number today to check the status on my claim. i was told it was sent before "someone" for a second signature. does anyone know what phase of the process this alleged second signature is? its been almost 1 year, so hopefully not too much longer...martin

just out of curiosity, i called the 1-800 number and spoke with someone that i could barely understand as their obviously (accent wise)from a middle eastern country. i advised that person what i was told last week, that my packet went for a 2nd signature on the 7th of March..holy cow! this person tells me that she didnt see anything like that on the screen, but only shows its been at the rating board since Dec 8th, 2006. i bet if i call again today, i'll get a totally different answer. you all are so right about the V.A. system. you dont know what to believe...martin

Martin,

If the computer sceen wasn't showing an award of some kind being entered recently, it's a possibility that your claim is atill with the Rating activity awaiting a second signature from another RVSR. The first RVSR may not have had single signature authority on claims and yours need to be looked at by a second rater, hence the "second signature." Having said that, I'm not sure if any of the computer screens the VA uses would have such an diary enrty of that nature, don't know, it's hard to tell. At any rate, instead of calling the 1-800 number for information on your claim, you should use the IRIS inquiry system on the VA web site.

Martin and others-

Most of us have info at the 800# on the Appeals Screen.

There are other screens too- and some reps dont want to take the time to access them.

Once in a while they tell my my claim was sent to the BVA. I have to tell them they are reading old info- please go to the covers screen and when they do the inof is current.

It is the "COVERS" screens that gives the physical presense of the claim.

They documented 3 separate signatures on that screen on my claim last year-gave me dates etc- VSM etc-

however these signatures were for an illegal remand to the BVA which I got fixed-fast-

I just hope this is good news as to the movement and signatures on your claim-

you have not been denied at all yet have you?

Vike gave you the best bet- the Iris system-

then again I think they gave me wrong info in December but whether it is wrong or not it became something I utilized in getting my claim to move.

My POA would not confirm or deny the Iris info-

and it showed-if true-they didn't do their job-

I copied their reply -make sure you do that too and save it-

I suggest NEVER ask for Iris response by phone-

they can send you a letter or an email link- click on the link and you get to their response.

If it is not suufficient you can add to the Inquiry.

Service complaints at Iris might take longer than regular inquiry- they go to VBA first.

My service complaint of December got my claim to move, and then my complaint about my reps to the Governor got my claim to move days ago-

Not that I think the Governor did that-

I sent my vet reps a copy of this complaint first before getting it in the mail-

they were horrified I am sure-

I told only half the story and it is not pretty-

but this could have prompted the movement of my claim due to POA intervention-

Claim over 4 years old, 3 IMOs, additional very probative evidence,past awards that support the claim,immediate BVA remand due to legal errors,

The VA denied me Benefit of Doubt and has never addressed my evidence in 4 years and my 4000 bucks worth of IMOs have disappeared.They were never considered at all.

This didnt happen in a vaccum-

based on VA they never got the IMos and the rep conference with my DRO was misrepresented to me by my POA.

VA cannot make decisions on medical evidence they never get and never see and even when a rep says he discussed at length with the DRO- my IMOS-

it is a lie borne out by documentation I have from the VA itself -and probably not at all the VA 's fault.

Just making the point-

you have to make sure VA has your evidence and then it stays in the c file and is reviewed properly.

Martin,Vike is right,my guess is that, you should get a letter before the end of the month.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
