Question

I have a scheduled hearing for SSDI in April. I am TDIU and concerned that by doing this especially if denied that social security wiil contact the VA. I am concerned about using losing my TDIU. I am 60 years old and have been TDIU for 5 years. Any comments would be appreciated as I am thinking about cancelling the Hearing.

Jim-you might want to contact ALLSUP, Inc. they are disabiltiy specialists who deal with SSA claims- for a fee they represent the claims they accept- they can assess your claim right at their site I believe-

They have a 97% success rate on SSA claims that they handle.

I dint know what their acceptance criteria is- but it might pay to check them out- there is a link at hadit to their web site.

Thank you Berta for your response. This SS thing bothers me and after 2 previous denials I hired a capable attorney to handle my case. I do not feel I am greedy it is just that all the surgeries, rehabilitations, and the 14 medications I am on I don't understand why ss is so difficult.

Jim,

I will just echo what others have said, chance are very good that you will be awarded SSD and should have applied years ago. If it is denided it will not effect your VA rating at all. Do not cancel, hang in there, if ever someone deserved SSD I think you do. Best of Luck

given all that I would think the SSD would be awarded and if they deny it, the denial would have nothing to do with the TDIU award from the VA, if you have an attorney let them do the talking they don't get paid unless you win, so they are going to present the evidence in the best light possible for you go for it

Testvet, thanks for your response I need to sit back and let the attorney do the work. I guess I got to tangled up with the process.

In my opnion social security was fair and timley for my claim. I had a more positive experience than the horried Walter Reed Medical Board. SSDI is an all or nothing process. This means you either get acceptecd or rejected. I made sure that I gave them a copies of all medical records ( 500 ) pages worth prior to my medical appointment with them. On the day I went make sure you bring someone with you for support and above all bring your medical records with you. The more medical documents you have the better you will be. Insure you have completed all required applications and that you stick to the statements that you provided to them about your disability. (Why you feel you cannot keep and maintain employment) How your disbility / medications prevent you not only from work but things in your daily life. If you are denied you have a better chance of getting SSDI using a lawyer. Most SSDI claims I have heard had to be put in mutiple times before approval.

I am a firm beliver that many things are connected when it comes to the VA. If they VA can find something to reject delay or otherwise reduce your claim they will do it. I am new to the VA claim system but 14 months and I am still waiting for the VA to process my C&P. I have learned only to submit fidings that support my claim fully. Hope this helped

NY-Steve
