Veterans Evaluation Services C&P

Question

I filed a claim for GERD, Stomach Ulcer and Chronic Sinusitis in March this year 2024 I had my C&P exam in April for all three.  My claim went from decision made and preparation for notification to scheduling me for a PHONE appointment for a records review with another C&P doctor.  What could this mean?

Well I’d say that’s pretty good! I filed for increase in C&P through my representative and crickets…I’ve even sent them questions and nothing. I’m also waiting on my C-File request sent in March. (During my last c&p eval my Dr told me I should be at 100% a long time ago and to contact my state attorney general due to continuity of care).

It "could" likely mean there was either a conflict of mdeical  opinions between one or more doctors examining you, or, that certain information regarding your claim etiology, symptoms pertaining to percentage rating, or date symptoms began for effective date purposes.  This is all specualtion as I have not read your file.  If you read your file, you may be able to figure it out.  Or, you can just wait for the decision letter.  You can dive into this as little or as deep as you so desire, but without access to your records, its all a guess.

Well I had my record review C&P exam today and it lasted about a little over five minutes.  It was only on my GERD claim and he only wanted me to verify what tests I was given and what the results were, which were a CT scan, an upper endoscopy and a colonoscopy, also the medication they put me on.  Nothing concerning the stomach ulcer or chronic sinusitis, not sure what to think, will see hopefully in a couple of weeks.

Well guys I got my decision letter yesterday.  I got service connection for Allergic Rhinitis 10%, Chronic Sinusitis 10% but not service connected for the Stomach Ulcer and GERD.  My VSO thought it was a good ideal to file under presumptive on everything and I think that was the mistake.  On the GERD it stated that service connection based on Toxic Exposure was less likely than not and on the bottom of the page under FAVORABLE FINDINGS IDENTIFIED IN THIS DECISION: you have been diagnosed with a disability.  Your VA examinations dated April 24, 2024 and July 24, 2024 showed you were diagnosed with gastroesophageal reflux disease (GERD).  Your treatment service records (STRs) showed complaints and treatment for abdominal pain, and diagnosed with gastroenteritis on December 10, 1981 in service, your private medical records (PMRs) showed a diagnoses with gastroesophageal reflux disease without esophagitis.  The evidence shows that a qualifying event, injury, or disease had its onset during your service, then it repeat the diagnoses with gastroenteritis during my military service, so can I just refile this as a direct service connection?  The Stomach Ulcer was denied under the same reasoning.  The gastrologist did state that the ulcer was probably caused my my long term use of NAISD (meloxicam) I was on meloxicam for over 5 years for my service connected disabilities for my toe, feet, and ankle they just took me off of it when I developed my digestive problems last year December 2023.  I think both of them were denied because I filed them under the wrong conditions (presumptive for toxic exposure).  Should I refiled under NAISD use for both or just the ulcer and direct service connection for the GERD since service connection have already been established?  Sorry for the length of this?

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
