Tips for Sleep Apnea Secondary to PTSD/Mental Disorder Claims
Moderator, you might want to Pin this somewhere, as this seems to be a recurring trend. I have given out this information to others, but I will post it here so that others can find it rather than searching through the forum. First and foremost, claiming and getting sleep apnea secondary to PTSD or Mental disorder is not easy. I have personally seen more lost than won, however, it can be obtained and I myself have personally received it. If you had sleep apnea diagnosed while in active duty, it is usually a slam dunk........for the rest of those trying to get it, it could require a lot of work. I suggest trying to get it both direct and secondary service …

Unemployability and working in a sheltered environment such as a family business
For example: a veteran with PTSD works for a family friend’s business. The family friend provides the veteran with an office and duties that afford limited interaction with other people. The veteran’s salary pays his bills, and is over the current poverty threshold. Because the veteran’s job has been tailored to his individual needs (limited interaction with other people), his job is considered to be sheltered, and therefore falls under “marginal employment.” The VA cannot consider this job as being substantially gainful employment, and must not use it against him in determining IU. https://www.hillandponton.com/unemployability-iu-guide/ Marginal employment shall…

ptsd Tips for getting your questions answered.
I cannot answer individual claims questions. All VA Claims questions should be posted on our forums. Read the forums without registering, to post you must register it’s free. Register for a free account. Some Tips from one of our members on posting on the forums. 1. Post a clear title like ‘Need help preparing PTSD claim’ or “VA med center won’t schedule my surgery” instead of ‘I have a question’. Knowledgable people who don’t have time to read all posts may skip yours if your need isn’t clear in the title. I don’t read all posts every login and will gravitate towards those I have more info on. 2. Use paragraphs instead of one huge, rambling introduct…

My disclaimer:
Advice given on the forum is in no way a substitute for consulting with a competent Veterans law firm, such as one (you pick your favorite) on the NOVA advocate website. https://www.vetadvocates.org/directory/widget_search?current_page=1&sort_type=featured&filter={"additional_info.show-profile-on-sustaining-membership-directory"%3A+"yes"}&asset_type=company_user&display_type=default If you already have retained a law firm, then you should follow that law firms advice instead of hadit members advice. ONE REASON: Many law firms have access to your VBMS file, while hadit members do not. Your law firm may well know about issues …

The TOP 5: Regulations and case law which help Veterans win:
These are my favorite regulations/case law which frequently result in a win for Veterans: Feel free to add how YOU won your claim, including the regulation or case law. 1. Caluza Elements: If you filed for benefits and HAVE all 3 Caluza elements DOCUMENTED, your approval chances are good. a) Current diagnosis b) In service event or aggravation c) Nexus or doc opinion that your current diagnosis is at least as likely as not relate to your in service event.
