C-File info assistance needed

Question

I filed several NOD's back in late May 2016, and at the same time I submitted a Privacy Act Request under the Freedom of Information Act for my C-File......ebenefits said estimated completion: 12/22/2016 - 04/24/2017......Current Status: Gathering of Evidence.   Those dates have now expired......11 months now.......have not heard a word from anyone.

Who can I contact to find out about my  C-File status as estimated dates have expired?    My RO is Waco, Tx.

Its not unusual for VA to "sit" on your appeal for the first year, and accomplish nothing, unfortuantely.  GEt ready for LOTS more delays, currently BVA appeals are taking 4 to 5 years, and that is about to increase.  If you have a "hardship", you can request an advance on the docket.  This means if you are losing your home and have children, or if you are over age 70.

If you read the VA's policy, if you start a claim while there is a claim pending, it becomes part of the pending claim.  The request for your c-file is a claim.  Not sure why they (VA) think its ok to lump a records request in with a disability claim, but, hey its the VA.

Wayne, have you viewed any posts (past 12 - 16 mos) on Hadit, where a Vet has received his (C) now E-File in under 13 or 14 mos, if not longer? I don't recall seeing any.

Back in 01/14, I received about 9in of paper C-File from a hand delivered FOIA request to my RO about 10/12.

I know, you would think it should be much quicker to burn a Disc Copy of our Digitised Claims records, then have a clerk physically copy 9in of paper. I filed another FOIA via Fax 10/16 for a Disc E-File, E-Ben indicates a completion date of 6 to 7/17. Maybe, but I kinda FDI.

I suggest you spend your time doing something more productive than trying to determine the exact arrival date of your E-File Disc. It's only been what, 11 mos.

That surprises me...Privacy Act 5,USC 552, records requests usually always go faster than FOIAs, under 5 USC 552 because they are handled differently.

Surprises me too Berta since it was sent as Privacy Act request...............I figured to have received C-File by now (11 mos.).  I got my C-File back in 2009 before I filed my first claim and that took only 7 months......all paper and heavy.........and was not a Privacy Request. 

I am still waiting on an answer from anyone here where I can contact to find out the status of my C-File. Thanks.
