Do I Have A Cue Case?
I filed a claim for my knees 2 months after exiting the Navy! I was denied my claim; however, a scheduled exam at the VA hospital revealed degenerative knee conditions a few months later. I am not sure exactly when my claim was decided but it was a really quick decision and the results of the exam may not have been included. I never appealed my case yet all of this happened within one year of getting out of the service. I never saw the evidence used in making this decision! Recently, I had my knees checked again at the VA hospital, and the VA doctor told me that I have arthritis in both knees and that this condition is the number one disability among sailors stationed abo…

Changing A Nsc Condition To A Sc Condition?
In 1974 I lost my original claim when the VA said that an alternative diagnosis was made, changing a psychiatric diagnosis to a personality disorder. Now I have in the records where the VA had awarded me a 50% disability for pension purposes, for an Adjustment Disorder with Depression and Anxiety. and 30 % for Sarcoidosis and gave me 100 % IU but this was only for pension. The original diagnosis I had when I left service was for an Acute Schizophrenic Episode, in remission demonstrtating moderate impairment to social and industrial adaptability. associated with depression and anxiety. The nervous disorder as they called it was changed to a personality disorder, bu…

Cue For Inferred Iu Claim
I spoke to a lawyer today about my CUE claim going back to 1973 on an inferred claime for IU. The thing he points out is that I was unable to work at substantial gainful employment from 1971 to 1985 and then I got a job with the post office and hung in there until 2001. He says I need to show that something happened in 1985 to make me able to work. I say that this is not part of the claim since I am saying that in 1973 I was IU and the VA failed to adjudicate the inferred claim. You see what I mean. He thinks because I did work for a period of time that the VA is going to deny the CUE for IU. There is no rule that says you cannot be IU for 10 years and then be able to wo…

Tmj-cervical Spine
BETRAIYED, I was never afforded a final dental check out examination before my medical discharge, my back was not well evaluated to make a determination during and after my medical board but I did complain of jaw pain and at the same time I had cervical and neck pain while in active service. Now the VARO denied my TMJ and cervical spine claims for benefits. And their is a relation ship between them and your case is prove of that fact. I appreciate u reply, also I am motivated with u victory and accomplishment. I am also very interesting in the rationalizations, reasons and base on how the VA granted you s-c for the TMJ issue if you dont mind and shear th…

Accordingly, The Case Is Remanded
1. Schedule the veteran for a va ortho examination for the purpose of ascertaining the etiology of his cervical and psychiatric disorders. the claim file most be available to and be reviewed by the examiner in conjunction with the examination.
