Education- Any Ideas?
Went to the community college with my son. We have lived here since November of 2006, and our son had been in school since then and recently graduated from our local public high school. Went to enroll him at the community college as a freshman and they are considering him to be a NON resident and must pay out of state tuition. We are paying taxes property taxes for this year as well as living in the community college district for the past 10 months. His fees for classes are $279.00 an hour. So his 12 hour (unit) full time fees are 3348.00 plus books and student health fees and parking.Probably a little over 4000.00 for one semester. His high school counselor told h…

Stress Test
Checked the automated system and found out that I am scheduled for a stress test, (my first). The doc decided after I had complained of chest pains and they did an EKG on me at the clinic that I might have Plurasey. So after xrays and no plurasey scheduled me for PFT 72 before treatment and only picked up 18 after treatment. Learned that the first visit in late April heart rate only 56. Not bad for a 30 year old athlete but for a fifty eight old fat man? Then June 25 at next appointment the nurse took my blood pressure and said it was high. I asked what my heart rate was and she told me 53- she changed cuffs took my blood pressure again and said it was bette…

New Cavc Decision Tells Va To Accept
Extraordinary- and maybe a big push for all of you who do such meticulous medical research for your claims and associate it well to your evidence: from email from Ray B Davis- Dear Readers, The Federal Appeals Court has ruled that "Lay Evidence" can be used to make a diagnosis of a medical condition in a veterans claim. The VA and the Veterans Court have ruled in the past that Lay evidence could not make a medical diagnosis. From the Court case (copied in it's entirety below my name) "(1) a layperson is competent to identify the medical condition,(4) 4 Sometimes the layperson will be competent to identify the condition where the condition is simp…

Recent Federal Circuit Decision- Not Cavc
Ray Davis' long time veterans advocate- has assessed this federal curcuit decision well--- his point is about claims denied due to lack of "competent medical evidence"---- In this Fed Cir. op they state the VA had rejected the veteran's buddy statements- these were crucial to his claim because NARA said his SMRS had all been lost in the St Louis fire. The crux of this matter is that the VA found no medical proof of the shoulder injury in service. The Fed Cir court however -in this opinion references Buchanan- and states that established VA case law is found in Jandreau CAVC 04-1254 at # 3- re points #1,2,3, and 4- (bottom of page 5 if you printed this o…

Va Gives Me An Ankle/foot Orthosis (afo)
I mean, I have this one pair of OLD OLD sneakers that are so worn out that I can get my foot in the shoe with my AFO on, but the shoes look like something someone would wear while shoveling out the barn (Why do they look like barnshovelingout shoes? 'Cause that's what I used to wear while shoveling out the barn!). I am ashamed to wear them. Wife wanted to take her Mother out for supper last night, so instead of wearing those shoes, I just took a couple rolls of AceWrap and wrapped up my bad foot/ankle, got my crutches, put on a good shoe on my good foot, and walked around like I had just broken my ankle. Only bad part of that charade is the fact that I have no stamina an…

Unimployability From 90 Percent
Good afternoon fellow Vets. I have recently been changed to 90 % disabled. Actually, useing there math I am 93 %, but it rounds out to 90 %. My primary care doctor at the VA has just placed the following statement in my VA records: "I have known Mr @@@@@@@ for approximately two years in the context of a doctor- patient relationship and am quite familiar with his physical disabilities and medical illnesses as well as his mental health problems. Given the totality of his clinical picture, I have no hesitation in stating unequivocally that I feel he is unemployable." I signed a release at the VA so that my service officer VVA could get this information and send…

Sorry I've Been Busy Getting Certified And Disabilities....
Sorry everyone, I've been gone for a while. Anyways if anyone can assist in the research and development of actual daily/constant contact with FUEL related medical issues, it would be greatly appreciated. For all those who are Marine and otherwise. I was stationed primarily at Camp LeJeune, North Carolina. My entire unit at Bldg 1108. 3 Years at that location and Marines were constantly getting sick after runs and returning to the "office". Come to find out a female Marine was preg (don't get me on this particular WM) and was having abnormal medical related issues (not the average issues). Anyways, a few weeks later contractors, military police etc...were there i…

Va Suicide Crisis
This is a good idea- I dont know how many of you have ever gotten calls at all hours of day or night-with a suicidal vet on the end of the line- as long as their call ID pops up (or if suicide threats in email as long as I can get their IP) I can get an EMS service and the police are dispatched too -in a heartbeart- I am affilated with local police,fire,EMS,911 etc-and they can dispatch to the specific state or town etc- immediately- fortunately most of this type of call -I was familiar with the vet and knew I could talk them down- some of these calls were however- a demand that I do something about their VA claim or they would kill themselves- I am not sympa…

Imo Evidence
I can't remember what post-in last few days- The question was if the VA could reject an IMO- "Concisely cite and evaluate all evidence that is relevant and neseccary to the determination." "Ratings Veterans Service Representatives (RVSRS0 cannot refute medical evidence submitted by the claimant with their own medical opinions. Rating decisions can cite recognized medical treatises or an independent medical opinion to support a conclusion." from: M21-1 Part 6, Change 118 Septemvber 23, 2004 What I mean is that the VA cannot ignore an IMO. They can refute it or they can rebutt it but they have to accept it,read it, consider it, and then either knock it dow…

Pending Award Letter - How Long?
Ok, Got my SOC for a partial approval of benifits dated May 31. Found out that on June 26 my file went from the appeals team to the final authorization desk. From what I understand my retro will require 3 signatures due to the amount of reto. So how much longer do you think this will take. I mean I do haveto do a Form 9 in a few week before my time runs out. What is the chance I will see award letter & retro before the 60 days rus out? Thanks. jecsb4
