Va Messed Up
Called my POA today to see if he new anything about when I may get my award letter. He went over the medical issues with me and mentioned two fairly serious ones that I don't recall as being mine! I told him that and he said I would have to wait for the award letter before I could fix/ report it to VA. He said my pending award of retro was awaiting approval. I know that I did get an increase in some of my SC, but if the VA over pays me for something that is not my condition then I will have to pay them back. The burden is always on the Veteran and his family, we even have to fix their mistakes!!!

ptsd A Little Warning For All -
One of my vets called me yesterday. In 1995 he was awarded 100% P&T, for PTSD, retro to '91. Last year called in for Comp exam. Examiner reported vet has improved. Vet fails to rebut report. Recent Comp exam reports still improved. Monday vet receives notice of intent to reduce to 50% compensation level. The VA has followed the 10 yr protection rule, in that it takes 2 exams reporting improvement to reduce a 100% vet. Now vet is in a panic. Watch for more of this as the VA tries to tighten budget. This is from the Spokane, WA, VARO. jmo pr

Navy Friend Needs Some Direction
Hey Hadit Members, Help PLease B) My Navy "Viet Nam" era friend needs some direction. He was in the Navy in the sixty's and discharged in 1966. He was vietnam era but never in Viet Nam. He hurt his back and the Navy gave him a "medical" discharge for a broken vertebre in his back in 1966. This vet worked in the construction business for many years and finally in about 1990, he had a back injury, then many surgeries but got no better. In 1994 he was 100% SSDI because of the low back. We are getting his service records sent to him. But is there a way he can find out right now if he was ever rated for the back or exactly how he was rated. He diffinately states th…

Can Anyone Explain ?
What does it mean when the VA says "A decision will be made as expeditiously as possible."? Can anyone tell me the VA's definition of expeditiously? I got a letter today stating that "Your calaim is currently under review by the rating board, and we are awaiting a decision. A decision will be made as expeditiously as possible." I already knew it is with the rating board, it's been there since Feb 7, 2007. Why are they wasting time telling me what I already know? When they should be spending that time getting a decision made.

Va Acted On Their Own
I had arthroscopic knee surgery on my right knee in September to repair a torn meniscus. In October I sent in paperwork to increase my disability on my knees, back, ankle, and a new claim for sleep apnea and depression. My AMVET rep gave me a heads up on the results. I was increased on my left knee and ankle, granted 30% for the depression (only had 7 months of treatment) and denied permanent increase for my right knee but granted tep 100% for two months because of the surgery. I had not addressed the issue The have not reached a decision on my back yet, but the screen shows that it is ready to rate according to my AMVET rep. Originally, I had filed a NOD regarding the…

Inferred Claims
I previously had asked about filing a CUE for a cervical condition my husband claimed. I have found I cannot submit a CUE for the condition - but am wondering if it can be raised as an "inferred claim" for accrued benefits. My understanding is that inferred claims for increased ratings for conditions that have already been service connected that have not been recognized by the VA - and addressed - are still "pending claims" Correct me if I am wrong on that. My husband claimed his cervical condition at retirement. Though his SMR's showed he had a cervical injury in service - he was denied SC as both the RO and BVA stated he did not show a "current disability." …

Denise Nichols, Usaf Maj. Ret. Veterans Advocate
Many of you sure know Denise- (DSNurse at Allvets,Inc) As a former Gulf War veteran and nurse she has consistently provided advocacy at the highest level (DC) to get these issues of toxins and chemicals etc into discussion and action as having service connectable potential. Denise has been a relentless advocate for veterans who were exposed to numerous chemicals, hericides, carcinogenics, and other toxins that was military materiale used by thousands of veterans ,due to their MOS or other means of exposure, and who have had resulting disabilties that are potentially stemming from these inservice exposures. The Carbon Tech bill went no where and now the TCE issue i…

Change Of Diagnosis
Can a VA doctor on a C&P evaluation change the diagnosis, of a previously rated skin condition? The same condition he underrated on a previous evaluation? I've had a diagnosis of Mycosis Fungoides-Ecxematous Dermatitis rated at 50 % over 12 year, this Doctor deduced it to 10% on a previous C&P evaluation. Now he pretends to change the diagnosis to Alopecia Areata, I understand with the intent of not been able to go over 10% disabling, Is he allowed to do that? Is there any recourse to prevent this? How accurate are VA biopsy's since they are ordered to prove the Doctors case? On previous biopsy's the results are the same as the possible(rule out) diagnosis, a…
