Looking For A Reg
I'm looking for a reg for others on here. Berta, Vike or Pete can probably go right to it. The reg deals with changing an existing diagnosis and states something to the effect that the diagnosis CAN NOT be changed due to only ONE exam. Thanks for the help. carlie

Question On Procedure With Soc & New Va Med Findings
Hi all, I have received my SOC from the VARO based on my NOD. I have secured copies of my C& P exams and regular VA exam by a specialized Dr for a specific physical condition. The interesing thing is the C & P and Reg VA Dr exam detail additional isses to my back and feet. Some are new and some are secondary conditions to my primary issue. So what do I do now? Do I submitt a new claim? Just list it on my Form 9? It's weard because the SOC failed to mention some of my other issues. My SO is not worht the time. It's is obvious to me that the VA places more credibality on the VA "Med Providers" than my civilain Doctors. Because after 3 years, It…

I Had My Imo Appt Today
but I just wanted to ask if you think this will suffice as new and material evidence to keep my claim open. It was supposed to go to appeal but I missed the timeline. I am claiming Reactive Arthritis from a PID infection in-service that was not treated in a timely manner. Here is what the doctor said in his letter: She probably has had a Reactive Arthritis, possibly PID associated which has affected the sacroiliac joints among other areas. To recap, the VA doctor said it was probably Reactive Arthritis but he put a question mark in front of it. One of the residents said the same thing. (cue) Vaopgcprec 4-2004 Precedent
Any subsequent award after previous filing is considered (CUE), it is undebatable when prior filings are construed in favor of the claimant. Means as in my case I filed for skull loss in 1976 and received no decision on it at all. I was recently awarded service connection for skull loss in Feb 07 based on the identical medical evidence that was before the adjudicator in 1977. According to this precedent the earlier effective date of Nov 1976 must be awarded to me based on this precedent. Hope you can all use this, it kind of makes it cut and dry. Commission On Va Benifits
I read in the paper today that the commission on VA benfits said older vets are drawing too much disability pay and the younger vets are not drawing enough. The reason being the older vets have already made their careers and did not need the extra earnings with disability pay. The younger vets have have longer to live and are not drawing enough money for the long haul. I just wonder how these people can say older vets deserve less because of age and time to live. I guess they don't count all the years some vets put in over seas, combat, not living with your family? Lets cut the congress and senate retirement benifits and all the other perks they draw. Made It To Post Determination
Just got word today that I moved to Post-Determination on 6/12/2007 (VA 800#). I currently have two dependent children one 13 and one 19 who just graduated this year and is a narcoleptic and Special Education. Is there some form that I should submitt to certify his condition? He will be attending a trade school this fall through Michigan Rehab? Will things come to a screaching stop because they need some form? Or will they simply ignore him and force me to file a NOD? Or is it all of the above?

Anyway, Vike17 and Berta, you two are familiar with my CUE claim for EED to 28 Nov 1976 of which should have been adjudicated for skull loss then but was not, and then finally adjudicated in Feb 07, ignoring the EED and assigning ED of 11 July 2005. They also made a grave math error in that they could not see that 4.5 x 4.5 cm was 20.25 cm2 (criterian for 50% is >7.355 cm2) and assigned a 30% rating in error and under reason and bases they used the same medical records from 1972 citing military records detail 4.5 x 4.5 cm skull…

Claims Pending At Time Of Death
I am sending in evidence to go with my DIC / accrued benefits claim. My husband had a claim for lung cancer (which he died from) pending at the time of his death. As my husband's lung cancer claim also provides evidence of other respiratory conditions are these also "pending claims?" He did not specifically ask that his claim be adjudicated for other respiratory conditions. However, wouldn't they still be claims raised by the evidence submitted in the pending claim? He was diagnosed with mild emphysema and Interstial Lung Disease 2 years after his retirement. He does have some reduced pulmonary function tests in his SMR's (FEV-1 / FVC 83.8 in 1986 and 82% in 1…
