Accrued Benefits
I was reading through my husband's VA claims in my spare time.... And I have a question. When we were arguing his cancer claim -- we noticed other claims that we think SHOULD have been granted. It was recommended not to reopen or claim a CUE on them until we were done with the cancer claim.. as it could pull his c-file in all different directions. When he died this February - the only open claim he had was for the cancer. In regard to accrued benefits -- would the only way I could present the other claims be a CUE? There are 3 claims: 1. Common Law Marriages
I know someone brought up the topic once in regard to common law marriages --- and if they would be considered if the state they lived in didn't acknowledge common law. I am posting this because I will probably NEVER find it again.... But it says that the VA CAN regognize common law marriages -- even if the state the person lived in didn't IF the person was NOT aware that the state did not recognize common law marriages. Another Question On Dic
The form says: "Note to surviving spouse: If entitlement to DIC is established, a "seriously disabled" child overage 18 is entitled to receive DIC benefits in his or her own right. A veteran's child who is seriously disabled and over age 18 must submit a separate VA Form 21-534 to apply for benefits." Since my husband's cause of death has not been service connected yet -- does that mean we will be running two separate claims --one for my son and one for myself - to show service connection. Or will they only decide the service connection on ONE of the claims -- and transfer whatever decision is made to the other one? Or do I wait to file my son's claim AFTER my claim h…

What Next? Need Advice!
The brown envelope came back. Service connection for and cervical radiculopathy left upper extremity 0% and cervical radiculopathy right upper extremity 0%. Right elbow tendonitis SC stayed at 0% and Right carpal tunnel syndrome denied. May total is 60% Cervical DDD 20% Lumbar DDD 10% Cervical headaches 10% Aniexty 10% Wrist (arthritis) 10% Shoulder (trauma) 10% Stomach (med side effects) 10% What should I do next? or should I do anything. Widows And Sbp Dic
This situation does not come up here much but it sure does on other sites--- Widows of retirees who paid into the SBP fund find that -if their spouse dies in combat-the SBP from DOD is offset to their DIC. The Corning Leader- our only local newspaper- had a long letter from an SBP widow in the Editorials as she just found out after award for DIC that it would be offset to her SBP. Her husband believed he would die in Iraq and took steps such as the SBP program to believe he was providing for his family.He did die in Iraq and I dont know who helped her with the DIC claim but they never mentioned the SBP offset. My husband I have been reading this board since Oct 7th (we joined Nov 06). And have learned so much information. We have followed the ideas and advice from here with some success and am grateful for all the wonderful people that dedicate so much of their time and energy to help other vets. Thank you. diabetes Long Post: Please Advise.
I need some assistance. I was medically separated from the military in 2002 due to a non-combat parachute jump. I incurred a head injury and was dischared with post-concussive syndrome and right sural nerve damage. I received a 20% disability rating. I presented to my current internist fatigue, difficulty with concentration and short-term memory, polyuria with 3-4 per hour voiding, and polydypsia to the point of near continuous thirst. hypertension Just Got A Call From Doctor's Office
I just got a call from my doctor's office. Over the past seven years he has treated me for hypertension, frequesnt nighttime urination, GERD, and have complained to him about lack of sleep on many occasions. He says that my sleep apnea is due to my weight gain since I retired (primarily in the last year) and will not write a letter. All those things he has been treating me for are signs of sleep apnea. I have to go seem him for another matter Monday and am going to have a talk with him personally.

Dic Claim
I am working on the claim form for DIC - so I can get the waiting game started. The bulk of it is about income - for claiming Pension. Do I have to fill this out if I do not want to claim for a pension at this time? I don't want to leave it blank and then find out 2 years from now they can't work on my claim until I fill it out. But I would not be eligible for Pension right now -- so it seems like a lot to go through for something you wouldn't get. Free

Ao Guam
When my husband was denied SC for his lung cancer the first time -- they stated he was not in Vietnam - and thus had no presumed AO exposure. However, he was in Guam. We had questioned whether to address this issue IN CASE the government ever decides to admit to all the AO in Guam. Should the issue be at least briefly addressed - in case they ever do admit to AO in Guam (to protect the orginal filing date)? I know if they admited to the AO - the claim could be reopened if it is denied -- but if we don't alledge at this time that his cancer COULD be caused by AO in Guam - then if they open up the claims -- will they process the ones that DID allege AO exposure pre…
