Unusual Claim
http://www.va.gov/vetapp06/files1/0601106.txt The veteran , exposed to AO in Vietnam ,had no pending claim at all when he died. The death was due to liver cancer. However the veteran ,by medical evidence, had received considerable radiation for Hogkins disease and there was a strong private medical opinion that the radiation for the Hogkins had led to causing the liver cancer. The private doctor who opined on this claim had a background specific to the field of this vets disability, had treated him for many years, and also supported his opinion in detail and added medical literature to support this. 80%iu No T&p No Chapter 35?
I was awarded IU at 80% but no T&P and Chapter 35. They said there would be future exams to determine the T&P. My question is should I be contempt with the IU or file for 100% T&P so I can have Chapter 35 benefits for my family.

Recieved 100% On Re-evaluation, But Not Permanent. Now What ?
I was medically discharged from the military June 2004. The VA gave me 100 percent disability[, unemployable but not permanent. I went back this January 2006 for a Re-Evaluation with Compensation and Pension. Just got the findings in the mail and they kept it 100% but did not make it permament, they ruled me unemployable but kept open the possibility of future evaluation because they still expect improvement. Here are my questions.. 1. When will they makle it Permament? 5 Years 10 years ? 2. Can they call me back after 5 years and reduce the 100 percent?? 3. I wanted to try to work some part time hours, and try to work a little, how much money can I make…

T&p
Just got the letter from the VA doc, Total and permanent it says and unable to hold a job permanently. We will have to wait and see what the VA says about this one. I think the Total and Permanent are the magic words.

Grounds For Emergency Hearing At Bva
Does anyone have any information on what grounds exist for successfully filing to expedite a Board hearing? Does the veteran have to be terminally ill? I have a case in mind of an elderly person with a cardiac problem, a history of recent hospitalizations, but not formally designated "terminal." He's trying to get an expedited hearing, and has been denied due to his not being terminally ill (he's in his 80's). Thanks.

Another Retro Pay Question
When you receive retro on a claim they pay retro rate based on the veteran and his or her dependents. My question is what happens when one of your dependents passes away before the retro amount is paid do you still receive their retro amount as they were alive during the period of time that the retro amount is being paid for? My son Christopher who I have posted about before lost his fight for life Jan 24, 2007. He has just turned 13 and will be greatly missed. Leroy

Dro/bva Hearing
I am preparing for my upcoming DRO hearing which I know will be followed by a BVA hearing. This is my opening argument for both. Any ideal or suggestions will be appreciated. Hopefully it will not be to harsh cause it only speaks of the truth and facts: I am here today to blah, blah, blah...... and to present additional evidence and arguments in support of my appeal. Cpap
Does anyome have any idea how long it takes to get a CPAP or BPAP machine through the VA. I am having my second sleep study tomorrow evening and should get the script this week. I have an appointment at the VA clinic in Evansville Wednesday for my semi-annual checkup (boy do I have news, since my last appointment I have been diagnosed with anxiety/depression, have had arthroscopic knee surgery, and now the sleep apnea). I am going to ask about getting the machine through the VA, but you all know how they sometimes like to blow smoke, so if anybody has any idea concerning the waiting time, I would appreciate some imput.

Update On Latest Va Data Fiasco
http://vawatchdog.org/07/nf07/nfFEB07/nf021307-6.htm It would be great if this additional security problem would call some attention to the overall VA system- The fact that this involves more doctors than vets (so far- the figures could change again) might trigger some definite oversight at VA. I wonder who the docs are- VA doctors directly involved with PT care?

Service Connected Diagnosis's
I have a service connection that is diagnosed as lower back pain ICD-9-CM 724.2. I recently had an MRI which shows 2 ruptured disks and 2 bulging disks pressing on the left side nerve roots. First question, will VA consider this part of the service connected LBP and second question if they do consider it part of the LBP do I stand a good chance of getting a secondary service connection for sciatica? It seems that VA uses some very general diagnosis codes. I will have my Primary care update the diagnosis codes tomorrow when I see him. Dale Jr 8
