tinnitus How Can I Connect An Illness To An Existing Sc Disability?
Good afternoon!! How can I connect a condition to an already SC disability? I have Chiari I Malformation and a host of other conditions. As the RO stated it in my award letter, they bulked all of my conditions as symptoms to the Chiari and listed it as a benign growth of the brain @ 60%,which is fine for now, but I have medical documentation that some of the conditions are listed as symptoms, such as Hypothyroidism and Fibromyalgia are stand alone conditions(yet listed as symptoms). Due to the fact that Chiari is pretty rare there is no real medical documentation that provides an absolute connection. Some of my Chiari symptoms are migraines, tinnitus, blurred vision…

Asthma Or Sleep Apnea
Just a note to all on this site you have helped me go from 40% to 90% because of what I learned here I can not thank you all enough. I put in a claim for sleep apnea and asthma the asthma was approved at 30% the sleep apnea was denied. If I file an NOD and get sleep apnea SC rating (50% I am on a bipac machine) will that reduce my asthma as they are the same respritory system I think or will they add it to the asthma rating. Any info would be appreciated

Starting To Prepare For Bva Hearing
Just need a couple of suggestions. Prior to submitting my form 9 for my appeal I requested a hearing with the DRO (this was almost 15 months ago). However, as today the VARO has not provided such a hearing. I have inquired about the status of the hearing at least a dozen times. I have received written responses from the VARO ranging from "we are working on it" to "we do not offer such hearings at this VARO." Since the submission of my form 9, I have also provided new evidence in support of my claim on six occassions. However, as of this date no SSOC has been issued. Today I was informed that my case had been set for a BVA hearing and I should be getting the …

ptsd Va Rated And Going Back On Active Duty... Implications?
Howdy, folks. I've searched for any info on this topic, but am bringing up a blank, and I'm hoping to be able to start a discussion on the topic and glean some useful information, as I know of quite a few folks out here who are in a similar boat as mine. I'm an Army guy with 29 years of service, 15 active, 14 reserve. I'm still in, as regular drilling reservist. I'm also 80% combined, 70 for PTSD and 10 for frostbite. Last year I tried to go on a tour of Extended Active Duty at my unit. Everything went well as the package was routed from office to office. The Command Surgeon signed off with an OK after I had been seen by both an Army Dr. and an Air Force Dr: bo…

The Tooth Fairy
Last I knew my claim was at the rating board. A NOD and a 2-issue claim. Today my state VSO told me that I had been awarded 100% sched hypothyroidism, 50% sleep apnea (BiPap), was Ch. 35 with no further exams and the ED was back in last 2003 when I first filed to reopen. He said 1 to 2 months to get decision letter but he'd try to speed that up. Anybody got any feeling for just how reliable this info might be?? I'm too paranoid to accept this info I guess, since I'm at only 10% now. Ralph

tdiu Most Recent Cavc Case-
"IV. CONCLUSION Upon consideration of the foregoing, the Board's June 16, 2003, decision that denied service connection for an abdominal disorder and denied referral for extraschedular consideration for his service-connected back disability is SET ASIDE and those matters REMANDED, and the remainder of that decision is AFFIRMED. In addition, because the Court does not believe that oral argument would aid materially in the disposition of this appeal, Mr. Cox's motion for oral argument is denied. See Constantino v. West, 12 Vet.App. 517, 521 (1999)." The BVA had failed to state why EXtraschedular was not considered. Also: " Here, the Board acknowledge…

Lower Back And Neck Problems
First of all thank you to this board. I ask some questions before and I feel they were probley pretty stupid questions by some of my responses. I will try to listen better. First of all I am at 50% for Depression and Panic attacks. When I was in the military I was seen quite abit for lower back pain. I had never had back pain before the military. After about a year and a half of military service the Doctors finally took Xrays not a MRI and here is the xray report. LUMBAR SPINE: The superior endplates of L1 2 and 3 have depressions consistent with Schmorl's nodes. This is the result of old juvenile epiphysitis. In the frontal view there is a slight scoliosi…
