I don't know anything about this just passing it on as I know you keep up with anything dealing with Nehmer. carlie From another website: Philly is in charge of reviewing all CLL claims for earlier effective date under the Nehmer stipulation. The RO's received guidance in mid-September that they would be receiving lists from D.C. of all the claims that would need to be sent there. CLL is not currently listed in VA's regulation governing Nehmer claims (38 CFR 3.816). Jangrin asked some great questions here today re: AO claims and it does bear repeating- the Nehmer decision altered retro regs for thousands of AO vets. The entire Nehmer Court Order and explanation of the Retroactive awards and Stipulation are at the NVLSP web site. Here are a few examples from the VBM: Incountry Vietnam Vet files claims for an ulcer due to service on April 1, 1989. VA denies and in the decision lists the veteran's diabetes as NSC diabetes. Vet then files claim on Oct 23, 2001 for the diabetes ,as he learns that the VA has added DMII to the AO list pf presumptives. VA awards diabetes claim as due to service. ptsd Results From Post Traumatic Stress Disorder Clinical Treatment Team (pct)
I start anger management group theraphy for 8 weeks next week and I also start PTSD Education Group therapy next week for eight weeks. I guess I am officially diagnosed with PTSD now. I am waiting for the copies of my last few physch appointments and cant wait to see PTSD listed in AXIS I of a pysch diagnosis. Then I will have to call my VSO and tell him, and make him eat the words I will never win a PTSD claim, I am still waiting on a PTSD C&P

Question
Just wondering if anyone out there has heard of fibrous tumors with a relationship to AO? Had a 2 1/2 lb tumor removed from my chest. It was sitting on my heart and one lung. The result is cardiomyopathy with an EF of 30. Have applied for VA compensation but am having difficlt time finding information linking to AO. Any and all help will be greatly appreciated. Noel mc

Just talked to our Rep this morning and the reason for a back long is because of the Vet's that are coming home from this miserable forsaken war are being put on top of the pile, and she said its causing a big back log everywhere.

Bva Case Cites Cavc

Hey All I called the VA this morning they say the claim is at the place where they authorize the claim for award but, they still wont tell me how much....any ideas? They said call back tommorrow or the latest monday to find out what my payment date is. I wonder why they wont tell me what the percentage is.

When filing form 95 for FTCA - 1.) Should you include statement of how your life is impacted by your disability, such as - limit of things you can do/miss out on, pain, pain meds, how pain meds affect you, long term effects.. etc... If so - does this go with line 8 (basis of claim) or 10 (nature & extent of injury)? Or do you just stick to med facts? 2.) Calculating amount - is there a schedual/table anywhere to help calculate how much you should ask for? 3.)
