Got Another Ludicrous And Illegal Ssoc
I can get around the SSOC-I am not too concerned about it-BUT again they failed to address the evidence-never even mentioned my IMOs---it was ridiculous- (like many SOCs I got in the 1990s) Now I intend to do all I can to get these VAROs changed- I want Buffalo top of the list- of course-because I have so much evidence that shows they are not doing their job-told them that too- I emailed them that they will get my NOD but I am sending both of the SOCs I got to the Veterans Disability Commission- they said the VAROs need more oversight? they sure do-I will tell them plenty- I promise I will do all I can to get these VAROs to at least read and consider our evidenc…

How To Read The Smc Rate Table?
Can someone explain to me how to read the special monthly compensation rating table? I need assistance in learning what all the different letters and numbers mean. I heard they range from K to R.2, but what does that mean? Also the letters L, M, M 1/2, O/P, R.1, R.2 and S? I'm looking at the rate table found on the VA's website, and haven't had near enough coffee to figure this one out. Thanks!

Diagnostic Codes, What Good Are They?
In my Medical Board Summery and on my DD214 and other documents, the DC for a specific mental disorder is listed with a corresponding VA DC. Their must have been some thought in listing the particular DC that they did, that the criteria for the DC must have been met for them to have done so or more closely met those particular findings in the DC used. What good are these findings and their DC's if the VA rating officer doesn't consider the time and evidence that went into, to support them, to list them in the first place? What good are these DC's if the VA Rating officer denies the claim, without finding fraud and/or error in the DC that supports SC, or uses a di…

Psycholigy Behind A Va Denial
Dear Fellow Veterans & Friends. I have studied this issue for years trying to understand why the RO's are so infurating and careless in there decission making process. OVer the past 15 years BVA and the court have taken away all the power the RO have. The law has identifyed allot of the RO pratices as being illegal and with appeals the vet will eventually get before a reasonable decission maker. Now in SS law. It requires the disabled person to be sick for over a year before they even apply. This is to put an econimic hardship on any one who has to go a year not abel to work and allot of citizens decide they cant afford to wait. THe VA does the…

Erroneous Statement In Soc
Part of my CUE claim points out the erroneous statement in the SOC, made by the Rating Specialist and signed off by the Adjudication Officer. If the VARO fails to consider the errors that I have pointed out, what is going to be my best course of action? Like Berta has stated, they have to read the claim first, to have any understanding what, where, and how the CUE occured. If they do not look past the previous statement of the case and read the evidence, then they are likely as not to just rubber stamp the previous ruling and deny the claim. If an appeal is in order, would it be prudent to ask for a DRO hearing, so that specific evidence that support the CUE issus…

New Claim For Loss Of Vision Due To Migrianes
I filed a claim yesterday for loss of vision due to migraine blindness on the advice of my VSO and VA neurologist. I have read the below text from the eye rating but I am a little confused about how I will be rated. The VA Neurologist has clearly linked my condition to my existing service connected migraines and the VA eye doctor has linked my current loss of vision to the migraines. I have a feild of vision a kin to that of looking at the world through a straw, absolutely no pheriphal vision - left or right in the left eye whats so ever. My vision is limited to about a 15% field. Are there any vets out there that can help me or are there any vets that have had a C&P …

hypertension Is This Cue
I had a c and p exam yesterday. I was allowed to view the service record and I found that I had been treated for Hypertension and Headaches in service. It was noted on the Separation physical exam. Tyhe Denial letters used by the VA in 1994 and 1998 said the records were void of any hypertension or headaches. Could someone , Berta, or anyone who has won a cue claim reply to this post. I think it is a strong CUE nut I am not sure how to word the claim.

Ratable Or Not?
I'm curious so I've come to the place where I know I will find answers! B) A friend of mine husband was sworn into the Army back in '86 and was sent off to Basic Training. Once he began his training the Drill Instructors noticed that he had limited use of his dominant arm so he was medically discharged. He served no more than a week or two. He doesn't know if he's receiving any compensation because he cannot find his DD214 but he doesn't receive any money. He is requesting his DD214 and SMRs. My questions to all of you is: 1. Is he entitled to service connection even though he only spent a week or so in Basic? 2. If so, what does he need to do to get the ball ro…

ptsd Ptsd Reevaluation Age 55
Can anybody advise if there is a regulation/law/etc... on the VA books that says that a veteran will not be reevaluated for service connected disabilities ( I am 50% PTSD, 10% tinnitus=60%, awarded 100% based upon unemployable ) once the veteran has attained the age of 55. Seems to me I read it either here or on a web search that stated veterans will not be reevaluated once they have reached the age of 55, unless "under unusual circumstances". If this is affirmative, can anybody advise the meaning of " unusual circumstances". I am 56 and will be 57 at a reevaluation scheduled for July 06. Can't think of any " unusual " circumstances in my history/background since my a…

ptsd More On Murray-ptsd Review
Murray Protects Veterans with PTSD from VA Scrutiny, Stigma and Penalties Senate Passes Murray's Amendment Today; Blocks VA from Wasting Resources Investigating 72,000 Veterans and Penalizing Those with Paperwork Errors For Immediate Release: Thursday, September 22, 2005 (Washington, D.C.) – Today, U.S. Senator Patty Murray (D-Wash) stood up for America's veterans by ensuring that those who need help with Post Traumatic Stress Disorder (PTSD) are not scrutinized, stigmatized, or penalized by a planned VA investigation.
