Confusion On Nehmer And Dm2
Need a little help here. I was diagnosed with DM2 in 1985. I did not hear about the presumptive application of DM2 with AO until early 2002 and filed then. I was awarded 20% for DM2 in late 2002. Does the Nehmer decision mean that I can ask for an EED 12 months before my claim was filed? Or more liberally does it mean 12 months before the effective date in 2001? Any assistance would be greatly appreciated! Ric

Appeals Management Center
Hi I recieved a letter from the AMC...for and decision for an EED dated Aug 25...Im tryn to find out who is going to process the retro payment...the lat time it took almost a year to get my back pay...and i don't want this to happen again... I now live in North carolina..so the VARO is Winston salem...but they don't have but part of the file...WV...Huntington VARO has juristction on it....I'm tryn to get a hold of someone who can make this happen...all of the telephone numbers are routed to call centers...I called Glenn who is a Supervisior at the AMC...but I left a message... Anyone know of any top brass to call about this...

Qtc Lap Dogs In Evidence
Attached are two docs that were isolated from the VA QTC Lap Dog Exam which states i have no lumbar problems, at all! Negative SLR etc. He did not have the benefit of my MRI's and Neurology consoluts which are in complete contratdiction to his findings but i have attached the 2 docs and will show them to the IME on Wednesday since evidently the VA tossed everything else out the door and just went with this. Weird thing is he increased my heart and feet issues. that makes me wonder if my heart is ready to give out if he would straight lie regarding my lumbar. How can he dispute his fellow doctors, who are neurologists, and MRI's that indicate all sorts of problems with x-r…

Time Table From U.s. Court To Some Decision?
Anyone get a remand at the U.S. court lately? I had 4 SCs remanded including my back which should yield a hefty back pay since it goes back to 2000. My lawyer said the case will be sent back to the BVA and we have the choice of letting them make a new decision or having it sent back to the RO. My take is send it back to the RO. I'm going to have my lawyer stay with the case till the end. I'm tired of being blind and want her going after them and not me. Is this a top of the pile deal meaning six months or is it a bottom of the pile deal meaning 25 years????????? Any input would be appreciated.

Appeals Management Center
i have claim at appeals management center. i i have been there two years this time on second remand . called and one time they said waiting on third signature , called second time said waitin on decision ,called third time said decision made waiting on authorization , would not tell me decision. asked if this meant if i had won my claim guy said not necessarily. said would recieve notice 4 to 5 weeks . any body been through this ? or know what is happening

Beneficiary Travel Program
Just a heads-up for fellow Veterans who may not have paid attention to this program. The short version: VA pays certain beneficiaries 41.5 cents per mile for travel to/from VA treatment. Depending on the type of treatment, it can be one-way or round-trip. TIP: Check your mileage yourself on Mapquest or Rand McNally, print it up, and have it ready in case the VA travel office has a different idea about the distance. The Beneficiary Travel FAQ (link below), Question 13, notes that mileage can be determined with "ZIP code to ZIP code" or through a site such as Mapquest/Rand McNally, whichever gives greater benefit to the veteran. Consideration Of Age
A recent issue of DAV's magazine mentioned a case of clear and unmistakable error where V.A. incorrectly made sort sort of determination that the veteran had been unable to find work because of age. There is a V.A. regulation that V.A. is not supposed to consider age in claims. A representative of DAV used that regulation in a winning appeal since V.A. is not supposed to use consideration of age in the claims process. Does anyone know of any winning cases where V.A. improperly considered age? Does anyone know of the regulation number that on consideration of age I am referring to?
