Va Changed My Claimed Items Or Ignored (Sorry If Not Right Place) Newbie
Any thoughts appreciated In short; 2013 IDES C&Ps 2014 fit for duty, hit 35yrs, 14 of SOF Ratings Letter rec. June 2015/ 100% (not P&T) due to an claim item that was overrated and will prob be reduced as their boilerplate langauge says will be reviewed in 6 months. 1. BBD (benefits at delivery) claim was Required and submitted Nov 2014. Preparing the BBD, the VSO and I filled out the claim form (to include 2013 C&P diagnoses on several items), for instance one eye diagnosis was 20% BiLat ref. Hi everyone. I'm so glad I found this site. This is bit of a long story so please bear with me. I'm not sure where exactly to start with this and was hoping some of you could advise me. In spring of 1987, after serving 2yrs in Army Reserve as a Combat Engineer (12B), I decided to go active duty. A pre-enlistment medical examination at the Beckly WV MEPS center found me to be without any conditions that would disqualify me for service. Shortly thereafter, though, while on leave, I crashed a motorcycle and spent a couple of days in the hospital due to various injuries. Cue Letter
My attorney wrote a letter back on April 16, 2014 stating about the my decision from 2011 was cue. Then they gave their response in Nov of that year along with my dependent claim. It was already stated by the VA rating board that they reviewed the evidence and determined my service department was wrong about their LOD. The tiger team made the first decision where it was mentioned on my previous determination from 2011. Help Please
Just got my decision letter back from VA everything was denied except for my Hypertensive heart disease with cardiac hypertrophy at 30%, that being said I continue to look at the report in Evidence Considered, they had put that my IMO had no Rationale and there were no link to my disabilities, looking at the full report I found treatment records from Salisbury Medical Center I have never been seen there, for the last 20 something years I have been going to Womack Army Medical Center in service and out (Tricare) no way in the Evidence Considered the mention of Womack Medical Center where the links and Rationale would have been seen. Cue Opinion
I met with my POA today and reviewed my records. I was denied in 2008 for service connection for my kidneys. The RD stated it was denied due to not finding service records of any treatments while I was in for chronic kidney disease, and also they did not receive proof that I currently had a kidney disease. I did not physically receive this letter, i had moved around that time and for whatever reason I did not physically get the letter. However, I followed up with my POA at that time and he explained that I was denied because they did not find service records. He requested a more legible copy of my service records. Please Help...is This Cue Or Not
Hello...newbie here and loving this site. I recently requested a copy of an " Denial" for a claim filed in 2003 with Cleveland Ohio Regional Office. I received a copy of letter today which sd verbatim : The evaluation of your service connected scar onthe neck remains less than 10% disabling and noncompenseable. The law states that VA cannot pay for conditions that less than 10% disabling. Service connection is denied for tachycardia and tendinitis. Unsure Of My Claim Situation
So of course I still call the hotline every blue moon knowing they feed you anything so I always call twice in a row to confirm the first call wasn't just BS. And I was told my pending NOD appeal is still that but now its assigned an area which is Philadelphia. I thought being at the regional office still which is where my decision was made at Philadelphia that that is where its been pending the NOD this whole time. So really was that even good news or just what its been all along but just not sitting in a file some where in line but now its finally at the end of the line. I Have A Question
I have a question to what is a CUE. The VA asked me to send in stressors reports to them to help prove my claim as well as medical evidence and statements and they gave me 30 days to do so. While gathering that info I got a letter from them 5 days later denying me my claim stating that I didnot send it in the proper time. Does this sound like a CUE??? or something else?

Cue For Eed For Tinnitus
Good Afternoon Everybody. Here recently My EED for Tinntius was changed to a CUE case by my VARO and I was awarded an earlier effective date but not to my date of discharge date when I was diagnosed at my C&P Exam. I was told over the phone by the VARO that if I disagreed with their findings, it would be best to file a Motion to Reconsider as a BVA would take around two years to complete. That later I could still appeal if I felt it nessessary. I have written a rebuttal concerning my Tinnitus which I'm posting here for review as my VSO is useless.
