21 Million VA malpractice payout
https://www.disabledveterans.org/2015/04/06/shocker-veterans-affairs-pay-21-million-malpractice/ The worse thing any vet or their spouses or survivors can do is to feel something was not right with their VA health care and then do nothing about having a real IMO doctor go over the medical records. It is an expense that may or may not reveal substantial malpractice but ,one way or the other ,that IMO will give them Peace of Mind. The link holds the pdf of this case ,won in the Federal Court. I have not read it yet. Either the VA's settlement offer was not acceptable or the VA might have even denied the FTCA case... The veteran is still alive, but his wife apparently file…

FTCA Reconsideration
My FTCA claim is into its 5th month. The VA paralegal investigating the claim said that she's only waiting for the peer review to be completed. She said it's supposed to be completed in the next couple weeks. I have additional medical information. Should I try to send it in now or should I wait? If it's not denied and negotiations begin I see no reason to send it. If it's denied, should I have the claim sent to the Office of the General counsel for reconsideration with the additional medical information? Berta I settled a wrongful death claim for my father's death. My user name back then was otey217. I'm fairly comfortable with the FTCA claim but not beyond the Regional …

I know it is over 6 years since my husbands death of cardiac arrhythmia (no autopsy, long story) no diagnosis of it prior. (in fact VA letter states no previous cardiac arrhythmia diagnosed) My husband's care was 100% VA. In the last year I have received additional records that make me question if some of his care was "lacking". Last year I finally received his sleep test from the provider (VA ordered and paid for) that shows "ECG appears irregular with unifocal PVC's" and then this year I finally received his chest Xrays and 2 different States sent me the same records for both states. Except the state that didn't do the Xray showed a line that has never appeared i…

Undiagnosed Genetic Disorder
Hello, I have a question. My wife was just now diagnosed with a gene mutation that she has had since birth (diagnosed by a PRIVATE MD, not a VA Doc). There is no cure for the gene mutation, but the treatment is supplement that she will have to take the rest of her life. She has been under the care of the VA Health System since the 1990's, and they have NEVER diagnosed this problem. She could have been receiving treatment years ago that would have increased the quality of her life, and would have perhaps kept her off of various narcotics for her pain. Can we sue the VA for NOT diagnosing and treating a genetic condition? Concerned in WA

Ig On Tomah And Stroke Victim Case
This stuff upsets me: In Part "WASHINGTON – An investigation by the chief watchdog at the Department of Veterans Affairs found practitioners acted appropriately when treating a 74-year-old veteran who died after treatment at the VA Medical Center in Tomah, Wis. The inspector general concluded a doctor failed to diagnose Thomas Patrick Baer's stroke as he waited to be seen in the urgent care clinic at the medical center, "however, the physician properly considered broad diagnostic possibilities," the IG report says. His family took Baer, who was from Marshfield, to the clinic Jan. 12 and waited with him for more than two hours to be seen by a doctor. He suffered two…

Sad Story
http://www.chicagotribune.com/suburbs/bolingbrook-plainfield/news/ct-bol-plainfield-veteran-suicide-met-20150523-story.html#page=1 Other than the VA's denial of service connected death, I do not see any further action this mother took, to make them accountable. She has waited too long for his records...Something stinks here... but maybe she will get some good advice through the newspaper if others try to contact her via the reporter. VA considers suicide to be willful misconduct unless it can be proven that the veteran was insane at time of the suicide. There seemed to be good evidence that this claim could have been awarded...... I do not even kno…

Supremes Decision Helps Malpracticed Vets/ Survivors
In part: :WASHINGTON (AP) — The Supreme Court on Wednesday made it easier for people to sue the federal government for negligence, in a decision that could affect military veterans with claims of medical malpractice. The justices, voting 5-4, ruled in two cases the deadlines for filing such lawsuits can be extended if plaintiffs tried their best to comply or simply failed to learn about important information before a deadline. Justice Elena Kagan wrote the majority opinion that combined the cases and upheld rulings by the 9th U.S. Circuit Court of Appeals that said the deadlines were somewhat flexible under the federal law that deals with lawsuits against the govern…

diabetes 21 Million Malpractice Settlement Va
"The United States was recently ordered to pay over $21 million to a veteran and his wife for damages from medical malpractice that led to a second stroke Veterans Affairs doctors failed to prevent. The victim, veteran Michael Farley, was 78 years old and the funds will pay for the remainder of his care until his death." Full story at http://www.disabledveterans.org/wp-content/uploads/2015/04/STROKE-Decision-Memorandum-and-Order.pdf Thsi is one reason why I continue to aggressovely fight the `1151 Stroke my husband had, that contributed to his death. Very few veterans have direct service connectable strokes, (I think Chesty Puller did but the VA gave him all so…

"Posted: Friday, April 3, 2015 2:00 pm PITTSBURGH (AP) — A World War II veteran who says he contracted Legionnaire's disease at a Pittsburgh Veterans Affairs hospital has filed a lawsuit against the federal department that runs the facility.
