Sexual Misconduct By Va Psychologist
I am curious if anyone can answer the question, does the VA have a Policy or Regulation which prohibits psychologists from having a relationship with their patients after they are released from the hospital?? Also, I'm curious if it matters if sex makes any difference. If there is such a policy or Reg, I'd appreciate a reference so I can look it up. I want to file a tort against VA for sexual misconduct but think the intentional tort exception would preclude me from proceeding. It is my understanding that State laws can not be applied to the US Government so I can't use that for the tort. If I can show that this psychologist was in violation of one or more policies…

Ftca, 1151's And The Dept. Of Veteran Affairs
Hey gang...long time no visit. I just want to share some helpful info with those of you, who truly feel that you were told that Statute of Limitations (SOL's) are a pre-requisite to filing a suit against the United States (in particular, your favorite agency, and mine...the DVA!). I am using my case as an example, however am not disclosing any sort of personal information. It's LENGTHY, yes, but very informative, and worth the time to read. Tort Claim Vs. St. Petersburg Va/tampa Va,fla.
Welll, just got off the phone w/lawyer in Austin, Tx. Michael Archuleta,J.D,M.D.,MBA(Archuleta,Alsaffar & Higginbotham) and he received the denial letter. They(VA) state "that although i was awarded 30% disability by the Va in a NSC Pension Claim for the injuries, I should feel lucky because if they made an award it would have offset my "Pension", for years". HEHEHE.noo kiddin!! Now, the lawyer wants too crank it up a notch. Federal papers will be filed in court, and were rollin,rollin rollin. Now, the 1151 papers are being filed, as well. Federal Tort Claim
As standard operating procedure my suit/records was sent too Ohio,from Florida, for an outside Med. Reveiw. Is'nt there a Reg. that states they have 30 or 45 days to get that info back to the Regional Counsel lawyers ? could have swore i read that. Thanks, William
