ptsd Help I'm Confused.
I have been getting conflicting information about FTCA claims, in one it states the SOL is two years, and then there is another SOL of 6 months from the incident. I don't understand how this works. We are thinking about filing an FTCA claims because of a C&P doctor that lied on the c&p my husband got in Jasnuary 2010. We then applied for an amendment to the c&p which we just got back, and for a second time the doctor has stated that my husband has no heart disease and is taking no heart medication. My husband is currently 100% sc'ed with PTSD. When he found out the doctor had not completed the c&p correctly he flipped out, after he calmed down …

ptsd New To Habit, But Need Help And Suggestions
I have been researching this for sometime now and haven't even found anything close to this type of lawsuit online. I already have a lawyer so that part is already taken care of. I suffer from 30% PTSD at this time. I served in OIF1. I have been seeing a physiologist at the VA for 5 years every week on Tuesday. I have been working forever on trying to figure out a better way to live with my PTSD. I work as a contractor in my everyday life supporting my family and a nice chunk of bills. One day I get a call from a lady telling me that she wants some work done on her house and like the business man I am I get right on it, through the talks and all I get the job. Shortly aft…

Ftca Offset
http://www4.va.gov/vetapp08/files3/0824103.txt veteran received a cash payment of $775,000 due to malpractice at a VA medical center under FTCA The veteran's Section 1151 claim -filed separate;y from the tort- came into play and the VA said they made an over payment to the veteran. To the tune of 234,372.In 1151 compensation. This BVA case is a good example as to why anyone -vet or widow- with any FTCA issues-needs a lawyer. Unless they can spend the considerable time it takes to understand FTCA laws and their relationship to all the VA regulations.

Ftca Claims
FTCA claims get into many nuance of legalize that truly require the expertise of an FTCA lawyer. These links are helpful in understanding some of the legal aspects of FTCA. Also what can appear to be definite malpractice, after a thorough reading of the medical records by a medical expert- might not even be close to malpractice. I saw this happen personally quite a few times .Once when a local VAMC vet appeared to have horrific malpractice case. He had the newspapers do a big story on the treatment he received and it read like a horror story. He contacted me through the VA Chaplain in Bath and sent me some of his med recs. (Some)and the newspaper article. Long…

Neck Numbness Section 1151 & Sf 95
Hi everyone, On April 1, 2008 my son signed a VA Consent Form for Treatment/Procedure and under item #17 Comments of that form it states "Patient would like to have relative joining him on day of surgery informed of results of frozen section prior to full neck dissection who will aid in decision making." On April 3, 2008 day of surgery the doctor met with my husband and I as well as my son, and doctor stated to us that they would not perform anything but frozen section and that they would confer with me as to what procedure to perform next. Once frozen section was completed they went ahead and performed a full neck dissection without conferring with me. If they had …

1151 Or Ftca
I had an incisional right flank hernia repair (01-14-09) as a result of a kidney removal which is service connected. The surgery has resulted in a new hernia in the new incision. As a result of this,I have lost my job, I am suffering multiple medical problems including depression, lower back problems, walking with the aid of a cane, digestive problems, and constant pain at the surgery site. First, the doctor claims that my surgery is not service connected, yet I am rated at 30% for the kidney removal. Second, the doctor states there is nothing wrong with me and he has done the best he can do. Third, he states the difficulties I am having are a result of excessive weight g…

Looking For A Ftca Sample Complaint Or Template
My husband and I are 1) looking for a lawyer to handle a FTCA suit, but in the meantime don't want to lose our six month deadline (after the denied Admin. process) and have to file the initial paperwork ourselves. :D Does anyone have a sample or template complaint that can be used as a guide? I heard that a hadit member (Berta?) had a successful filing; is that complaint or lawsuit available online to give us an idea of what the format needs to cover for the fed court? Any assistance given is greatly appreciated. Thanx and blessings all! B) AFWife
