Had A meeting with my vocational Rehab and employment counselor on 8/20/14, and received a letter from department of vet affairs rehab that states "As your vocational counsel, I have made a determination that it is not feasible for you to benefit from a program designed to return you to gainful employment. However we will be providing you an evaluation for individualized independent living service" Today I also receive a letter from my same counselor stating, Because we are denying you vocational and employment services since we determine that you are unable to achieve a vocational goal, we completed a preliminary independent living needs assessment to fine out whether you might qualify for independent living services in stead of RE-TO-WORK services. We were not able to identify any independent living needs at this time, therefor we will move toward closing your case for now. this letter is your notification that your case will be close in 30 days from this letter (8/20/14) The two letters were received on same day today 8/22/14 from Department of Veterans Affairs Vocational Rehab and employment. I have an appeal in since Aug 2013 for IU does this mean Iam "Unemployable" ???? I just cannot think strait.

Iam 70% SC and have an appeal at the BVA/RO and have been certify and form 9 date stamped on 12/14/13. The appeal is for IU, and tinnitus. I chose to have a face to face with judge at RO and will have a rep from Florida Dept. of veterans. stand by me at hearing or talk in my behalf and help me if need be. My questions is this (1)How can I find out how far in line iam to see a traveling judge (2) does my claim go back to NOD or just dated form ????? and last Is there anyone I can call other than 800 line to get how long must I wait and when do these judges come to the RO???? Thank you in advance

Next traveling judge will be in St Pete April 7 too 11 and August date not yet made as per BVA. Cannot tell by my docket if I will be heard in April or August or they may pick me at random because of my appeal being one.

I have a BVA appeal for IU and have just received a letter from Florida Department of Vet Affairs stating that my RO BVA hearing at local office before traveling Judge will take 18 too 24 months. I need some advice, should I get myself a Lawyer or is there any other way I can at least cut this hearing in half I have done all the work till now by myself but this is insane. I have provided to more piece of info which state from my social worker and PRRC center that I cannot work. Iam trying to get a IMO from my VA doctors Prime, psychiatric, psychologist and they have agreed to help me. This appeal also includes Sleep apnea, tinnitus, and vertigo. Any suggestion out there I sure would appreciate it.

Oh I forgot to say the gave me my SMC for ED Thank you all for your help and comments. At 67 I sometimes forget things. LOL

Well here is the latest on my BVA appeal, I elected to have a hearing at he RO with a VLJ in St Pete RO. I did file my form 9 and form 21-8940 and my VSO said he is pushing for my IU which I forgot I had filed for. Anyway I have set more evidence regarding my Unemployability to my VSO so it can been seen by the VLJ. Iam now at an PRRC program four days a wk for ????? long. The program is Psychosocial rehabilitation and Recovery center. I have not worked in 12 years since 2002. My social worker here at the VA center has given me a letter stating I cannot work and come to this program. This program is outpatient only for long term recovery and learn to cope with major and severe mental illness affective disorders and PTSD. I was given 70% back in 8/9/13 and the paper work for Unemployability etc was started two years prior. I looks good for me what do you guys think ????? Will let you guys know as it comes together

I have just receive notice that my appeals have been certified and sent to BVA, does this mean I no longer can follow my appeals on Ebenefits and 800 number???? My VSO said he took care of all my paper work but I followed up on my own just to make sure. Any advice ????

Received retro on 12/24/13 but only of 3months instead of 38 months. I did notice that on Ebenefits it shows my future payment at 70% but an effective date of 9/8/13 ??? did they give me increase base on new C&P given on 9/8/13. ???? Three other appeals were certified and are being sent to BVA from RO to Washington. My VSO rep help me with forms and sent out. Now he said 12 to 18 months at BVA

Just looked at benefits shows new rating of 70% 0n benefit verification letter but no retro to savings account. Still waiting for letter they sent out.

Yes that was what I did on 3/23/11 with NOD letter. This does make sense to me should be effective date 8/30/10 what can I do.

I files claim back on 8/30/10 effective date for PSTD and was granted 30% on 3/7/2011. On 3/23/2011 I sent a NOD to RO indicating my support of a higher rating witch was received by RO on 3/24/2011. On 12/14/2013 was granted an increase of 40% too 70% up from 30% and now rated at 70%..My question is this they are only giving me my reto from my last C&P which was 9/9/2013 4 months. My effective date was 8/30/10 and NOD dated 3/23/11. I have been fighting this increase for close too two years, showed them by med evidence that my PSTD has gone hay wire why did they only grant me 4 months retro instead of reto from 8/30/2010 from which I first claimed

I put in a FDC on 1/2/13 for ED secondary to my PTSD and medication given me over four. My VA doctor in urology confirmed this on 7/10/12 and posted on my progress notes at Tampa VA. MY question is what date do they use to retro my pay, is it 1/2/13 or 7/10/12????? I was approved 0% and awarded SMC-K at 100.00. I was told this by my VSO. On my FDC the only dates I used for claim was 1/2/13 because I thought they would automatically go back to that date. I had a C&P on 3/13/13 and doctor did confirm cause of ED medication. VA put me on these medications on 1/5/99. Can any one let me know if they will automatically go back to 1/5/99 or 7/10/12. ?????

I put in a FDC back on 1/2/13 for ED due to medication secondary to PTSD and was awarded 0% and SMC-K award. My question is do they go back to the time I started the meds or due they use the date I claimed it. Back in April of 12 they were having me tested for low tes and what not and gave me boner pills which did not work got me sick then they changed to another pill which helped. Due they go back and check these notes or did I have to tell them??????? Any comment would help for retro.

I do rpo and it takes sometimes 4 to 6 wks, Tampa is very slow. You must keep an eye on your T/P you put in your sheet and they lose it, happen two times with me.
