Further update: Yesterday, I received a call from Kim, at B&M, advising me of the joint remand document filing,(which I already knew from the CAVC site), and that they had completed their service to me and they would be sending me a complete digital copy, of my c-file, on CD. She also wished me good luck and advised me that if I had any questions to feel free to contact them. Both they and I feel the evidence is there, plus she advised me that if I had anything probative to add I should submit it now. All in all, I'd say I'm pleased w/their service. I anticipate an award on the SMC issue and the retro diabetes award of a few months EED. They certainly worded it much better than I would have. pr
  2. If your PTSD, solely, makes you TDIU, then I would say "yes." If not, then "no." jmo pr
  3. If your disability was awarded "after" your student loans you should apply for a waiver. If not, you borrowed the money, why not pay it back? jmo pr

  5. Here's an update: I received a new BiPAP machine, thru Medicare, which is set at 21 for inhalation and 14 for exhalation. I've been using the machine for eight nights, faithfully, but I'm still waking up 5-7 times over the course of the evening. I usually wear the machine between 9-11 hrs. Any thoughts as to why I might be waking??? Thanks to any who respond. I'm using Lincare, Inc. , a national company. pr

Update on my SMC claim: On 11/30/2012 my atty's (B&M) and the VA filed a joint motion for a remand, to the BVA, on my SMC claim and an EED on my diabetes claim, thereby probably guarantying them payment from the EAJA for their services. The remand was mostly for my continually prosecuted SMC claim, dating back to 1989. Judging by what I've read it has a good chance on winning. As for the issue of the math used in the 100+60, I doubt that will be addressed but ya never know. (jmo) pr
  9. I would pursue it but first I'd check to see what the ratings were back in 1970. They may have erred and retro could be possible. jmo pr

  11. TDIU is for claimants who are individually unemployable (IU), not just unemployed, for a long time. I don't think you need to worry about the reason you lost your job but it certainly won't help you prove IU. You are certainly welcome to apply for TDIU. jmo pr

  13. FYI - The act of suicide in of itself is not done by a sane person and therefore he would not have been sane, in his attempt, and the VA would have a hard time proving he was sane. The law makes the assumption that we (humans) want to live and will do all we can to suceed in doing that, which is why hospitals go to extraordinary measures to save our lives, when we are unconscious and can't speak for ourselves. pr
  14. Cynthia80 - When did you receive the letter that they plan to cut his disability benefit??? I'm confused by your posts. Are you saying that they said "it was a CUE that they are taking his disability comp away???" pr

Don't worry I've made arrangements for those I care about to be notified of my untimely death, should it happen, unexpectedly, and both you and Hadit are on the list. Besides, I'd never leave Hadit w/o an explanation. I doubt I'll find a VN bride, at least not in VT. I may have a better chance in Fayetteville, NC, as there is a VN restaurant there, that I stop at when I go to the VA. Guess I'll either have to look harder or settle for any bride.   16. OK, had a new sleep study and they'll be putting me on a BiPAP, which I'll be going thru Medicare and my Medicare co-ins for. Has anyone any dealings w/Lincare or Apria medical services, either good or bad?? They appear to both service my area in NC and in VT, when I'm home, but I don't have any experience w/either. Any assistance would be appreciated. Thanks again! pr

I agree w/bronco, however I would send the VA a letter stating that they made an error and that you should have been included in the recent review of claims for TDIU w/SMC, where the VA had to review all those claims. Can't remember the name, right now. Sorry! I believe they may owe you back to '07. jmo pr
  18. I can see their reason for not showing military honors, as they will be taking them away one of these days and they didn't want to have to remake the video. As for me I want a "direct cremation" w/no service, no obit and maybe just a few old friends getting drunk & telling lies about what a great guy I was and maybe a widow, of VN origin/decent, to receive my DIC (still looking). Need someone young, so they receive my DIC for many, many yrs, just so the VA remembers me. pr

  20. It's a shame but that's what life has become. Honor and ethics no longer exist. It's cheaper to fight the claims and lose a few than to do the honorable thing and admit the error and take care of those injured. Just look at the people who worked the 9/11 World Trade Center attack/disaster. Kinda glad my yrs in this "new world" aren't to be that many! jmo pr
  21. If you'd list your current ratings numbers we could explain better. The VA uses something called the Combined Ratings Table (CRT) http://cfr.vlex.com/vid/4-25-combined-ratings-table-19774341 As for your scar, depending on size/pain, it could receive a rating, but it won't be retro, as you needed to file for it then. pr
  22. Thanks to all who responded!!! I sincerely appreciate it. It appears VA services, for OSA, rate from very poor to really great, depending on which VAMC you deal with. I use my CPAP faithfully, every night, but still wake up 4-5 times, nightly. I hope to resolve this when I get a chin strap and a BiPAP. Only time will tell. I'm currently trying to run it thru my Medicare, as replacement masks will be more frequent with them, than w/VA. The VA would just as soon never update the disposables, for cost savings reasons. Thanks to all your feedback I'll be pressuring my VA for better service! Thanks again!!! pr
