  1. Why did the Va give me a pension, for chronic anxiety and depression, to which was denied, due to excessive income? I secured the psychiatric records from the archives and the letter from the commanding officer as to why I was given an early discharge, in 2004, new and material evidence to re-open my claim. Why did the Va sent me for a C&P for an " Acquired Psychiatric Disorder" and not the Chronic Anxiety and Depression, to which I was granted a pension for? Any one know the answer.   2. Free and Carlie, Yes, I did post that just the other day and when I went through my claims, I realized that I couldn't understand them either. I wanted ones out there, who may have trouble with their claims, to see if mine would give them any direction to go. I feel that the 2nd C&P was seeking a denial. That is what I have stated in my letters to the BVA. Why did I need another C&P within 5 months of the first one? She the lady doctor, did nothing to add to my diagnosis. She typed up a report to slander me and to dis-credit my claim and why does the male psychiatrist refuse to sign the C&P? Her C&P write - up is a doozey! Not one shred of evidence in either military or private medical records for her to come up with her opinion and certainly not from me. As I have stated to everyone." Never walk into a room with two doctors." If they won't allow anyone to go back with you, you may assume there is a reason, that you are not thinking about. Why did the BVA direct the claims file to go back to the two psychiatrist that participated in that examination, when I had turned the letter by Dr. B. C into the R.O and also a copy to them, with a rebuttal to her accusations. Why did the XXXXXXXX, West Va. Office refuse me a new C&P? I have raised all of these questions to the BVA. As John stated, " How did they change diagnosis on me and Why"? Thanks, Josephine

John, I have not been able to understand, how I received a C&P from the R.O after turning in my form 9 for the BVA and then after that examination of a more likely than not be transferred to Huntington and then have another C&P and then receive a Supplemental Statement of the Case with the form 9 being turned in almost two years before a decision was rendered. By the time I received a denial, I was waiting in line at the BVA and my number was getting closer on their docket as I stayed at the two R.O? How did this happen? My Statement of the Case, I received the form 9 and a letter from the DRO at the Roanoke R. O , You may have a personality disorder, This is not the DRO's Final Decision as we are sending you for a C&P Josephine
  7. gwvet90, I wasted 4 years with the rating board and the dro process and none of my medical records from 1965- 1979 were even considered. I went for my first C&P examination and all was fair and above board with a more likely than not. I am guessing the Va couldn't handle this and sent me for a board of two for a denial as that is what I recieved. I went to the BVA with the advice of the National Level of the American Legion. I was remanded to the AMC and have been there 5 months and they are making a complete investigation of my claim, as my medical records were twisted and turned, just as yours were. If the Va cannot find anything in your records to deny your claim, they may as in my case, fabricate to give you the diagnosis they wish. Go on to the BVA and not waste your precious time. Josephine
  8. When I first saw this posted, I thought sure that it was my claim. It sounds like something from the Salem Medical Center. By the way, how do you guys know what they are talking about, when you are finished reading the cases? I try, but I don't understand half of what I read. Any help would be appreciated. Josephine
  9. Hi John M, I have no service connection for the illness, as I have had vestibular disease since 1994. I have excellent hearing, but had that horrible attack with the vertigo and the world spinning so fast, that it wouldn't stop. This spinning lasted about a little over a month, but it has left me completely falling over my feet. I must take antivert before I go to bed at time, as I feel that I might as well be on a flying carpet. The pill helps to ground me down. When the attack first hit me, I had my two granddaughers sit in front of the couch in the floor, so that I wouldn't feel like I was going to fall off. This illness is terrible. The Neurologist will be of so much help to you with this illness. I know that there are others on this site that indeed have Meniere in the true sense and will be able to help you with your questions, as there's is like your husbands, attacks and not know when they are coming. Mine, from what all doctors can tell came from an innocent sinus infection that left a short or brain stem damage, from the nerve of the ear to the brain. I would make sure that the doctor acknowledged your husbands hearing loss in service, but just wanted you to know that you may have one illness without the hearing loss. Sure hopes this helps and doesn't confuse you. You may read futher if you do a search on Vestibular in humans and (not dogs) on the internet. Always, Josephine

  11. The BVA remanded my claim to the AMC in Washignton and within the remand my claims file was to go back to the two psychiatrist which held the last examination. I will paste from the remand: 7. After the above development has been completed, the veteran's claims file should returned to the board of VA psychiatrists who participated in the April 2005 examination for clarification of the provided opinion. They should be requested to review the record and reconcile their opinion as to etiology in light of the evidence added since their examination of the veteran, including the May 2005 statement of Dr. B C. C------ and the January 2006 statement of Dr. M P-----. I did receive a letter from the AMC that they had sent my claims file to them for a new opinion. The two psychiatrist replied: C-file Read Read Dr. C Letter no evidence to alter conclusion -Signed Dr. L Read Dr. P Letter no evidence to alter conclusion - Signed Dr. B. I sent a letter to the AMC that the two psychiatrist did not follow the remand per - 38CFR 19.8 & 19.9 and others rulings that are applicable. I called the medical center and ask Dr. B to be present, " I was told no". Josephine
  12. gbennett, Where did you go? Berta remembers your claim as being PTSD and not verified stressors. Maybe you are suffering from Anxiety and it may be called PTSD. but it is not the same. If you look at claims at the BVA there is a difference. It is a confusing rat race, and believe me the R.O will do their best to confuse you.   13. Jangrin, Well I have them ready to fax again. I have two Statement of the Case, each with a denial of course. The Va will not acknowledge receipt of my private medical records of 1965 - 1978. My VCAA notice has no evidence to support claim to date. This would of course be back in May. I have ask for a corrected VCAA notice with these important medical records stated. No VCAA notice corrected to Date. Give up. Claims file is at the Rater. I am faxing all medical records from 1965 - 1978 Letters presented to R. O of May 2005 by husband and two daughters again today and Buddy letter. My VCAA letter said to hurry with the info, as they may decide your claim within 60 days. It has been almost 6 months. No chance of that. It is my understanding that you have one year of receipt of VCAA notice to send in information. I do not feel anything will be decided until after that time passes. I must have all information in as I cannot add info, if this claim should go to the court of appeals. This claim is opened to 1978 and I have no room for error, due to the Va not securing my psychiatric records and the letter from my commanding officer explaining my early dishcharge and reasons for. Claims file of 1978 was never adjudicated. Re-filed in 2002 and same thing happened. I secured these vital records in 2004. The BVA has acknowledged this. thanks, Josephine
  14. I noticed that I had a letters by my two daughters and husband that did not have this written on it and thought that I may need to re-fax these again. I have not written this on my doctors letters. I assumed that the Va would contact him. I finally made it to the rater and have no room for error. I should re-send these letters. Correct? I am at the rater and I have to end this claim. Thanks, Josephine
  15. LarryJ I sure wasn't expecting the doctors at the Va. medical Center to do these tricks, but sure did find it out. I don't even know why the R.O ordered the dumb thing, when I had just had a C&P 5 months earlier and received a More likely than Not. I think that I was there, by orders of the R.O seeking a denial. Sure hope that I can prove this to the AMC and maybe some of this nonsense will stop. If not, this lady psychiatrist, had better what out for her license. I have been told to wait and see what my answers is, hope to receive it within the next couple of months. It has been a long 6 years. It all started with the psychiatric records and the letter from my commanding officer. I secured them from the archives in 2004 and they were never acquired or seen before by the Va. I have been at least given credit for this by the BVA. Thanks bunches!! Josephine
  16. Larry J, The appeals Manangement Center will read these statements, won't they. I know that I may be fighting a loosing battle. I will never agree that any doctor should be allowed to change your military and private medical records , just to give you an illness to disqualify you. I have heard from the same medical center that this doctor is doing the same thing to every veteran that comes through her doors and this would be from the nurse that saw me after the C&P. This is not right. I feel that I am strong enought to fight her and the system and see if I can bring her and any others like her down. There are so many young veterans filing for benefits and have no ideal of what is going on. I have always been blessed to have a strong husband and two lovely children. They don't have these things and I have to keep fighting for them. When I approached the BVA. I asked only to be heard. No more. Thanks, sure hope that they do read my statements, as I have drawn them a map so that they can see in black and white where and how she did this to me.   17. Berta, I certainly didn't mind placing it on my papers, but wanted to make sure that I had it on everywhere the Va. wanted it. Berta, I didn't place it on any of my doctors statements, as I didn't want to mess up the papers. I don't know what Terry meant, when he said, they wouldn't read the statements anyway. I sure hope that my time of putting this claim together has been for nothing. I knew that you couldn't add anything when it goes to the Court of Appeals. I want to make sure it is all there.   18. Terry, My letter dated May 8, 2006. If you wish to submit information that is revelant to your appeal, you may also include the infomation on the enclosed Va Form 21-4138. Statement in support of Claom, or submit the information on a separate sheet of paper. The separate sheet of paper must conclude with the following certification. " I hereby certify that the information I have given is true and correct to the best of my knowedge and belief". Chances are the VA wont read what you wrote any ways. Terry, Are you saying that I am wasting my time sending them anything. What do they read and what do they use to base their decision? Josephine
  19. Hi to everyone, Please I need some assistance. I called the AMC this morning and was told that my file has finally made it to the rater. My concerns: After reviewing my statements and letters to the BVA and the AMC I noticed that not all of my correspondence has the wording. I hereby certify that the information given is true and correct to the best of my knowledge and belief. Signature. I called and ask the lady at the AMC about this and she said that it wasn't necessary for all letters to have this written on them. It is my understanding, I still have time to re-fax these with the certification on each letter. Can I believe her or do I need to resend these important letters and does my physicians letters that I have turned in also need this affixed to them. I do not believe the BVA or the AMC, knowing that once decided, I cannot add to the claim. It is very difficult for me being that Code 6, Sensitive File. Seems that no one can access my file. I can't call the toll free number, as I live in the state of Va. and my claim is in W. Va. My rep, I have never met him and he is over 200 miles away. When my file was at the R.O, My representative could never have access to my file. Seems a bit unfair to me. Thanks so much. Josephine

  21. timetowinarace, Thanks for the info. I will try to remember this when I see my EENT doctor today, as to why the tracer went to the right side of my Thyroid Gland. Josephine
  22. timetowinarace, I certainly didn't mean to offend anyone or even take their illness lightly. PET for Cancer? I read the post, and I honestly didn't think that she was speaking of a brain tumor and didn't read into the post that this was in question. Primary said that it most likely caused by 40 years of Depression. I had the PET in September. Please corrrect? But as you say, we are not physicans either, but at Cat Scan without contrast just doesn't cut it. Josephine
  23. This is the best site for depression. I get more laughs from some of the post, than I have ever received from all those anti-depressants that I have taken. At least you folks have a sense of humor left in you. I don't even have a brain for the doctors to find. Keep up the Spirit!! Josephine
