  2. I have had an acting Law Judge D. Reiss since my board hearing three and ahalf years ago. He presided at the traveling board, in the initial decision at the BVA he denied my AO. Upon remand bythe CAVC he remanded same to the RO. He is now set to render asecomd decision at the BVA level. Hangman justice I guess?
  3. I hate to scof since I have follicular cancer, just had a heart operation to remove a thrombus (tumor) VA, back to the RO, and finally back to the BVA. Clot formed because I had to have a high speed injection port placed in my chest because chemo made it extremeluy difficult to draw blood. Hurry ? Expedite ? You say ? Have had expedited process for serious nature to my condition since January 2005. Let me see ..........that is like 2 years and 8 months of expedition......!!!!!!!!!!!!!!!!!!!!!!!!!!!! Give me some of that good oh expedition.....
  4. Found out today that my Claim is now before the director; director of what I do not know ! Dirctor of BVA ? Any one tell me who this might be. Stated that an Congressional Insquiry is taking place involving the BVA and the delay for such a serious medical condition. Scheculed for a heart operation Tuesday July 22, 2008. BVA has failed to date to acknowledge receipt of certified letter from my Counsel requesting BVA hold any decsion until he submits a brief. Guess the BVA is learning how uncomfortable being on the hot seat.

  6. Armand I would no longer initiate a claim without a lawyer than I would go into a war without body armor and the a rifle. Thses people are not your friend. If for only the intimidation factor I do believe in having a lawyer. This does not mean tha you should depend only a lawyer to handle a claim you must be proactive for it is your claim ! Assist the Lawyer...Do research....In other words be involved. I know there are good Vet Reps I just have never found one. Randall

  8. I have a female Goden Retriever who is smart as a whip. She only does it in the missionary position. Just getting my mind in the gutter. Molly sleeps on her back and is quite a sight. I have have had Goldens for 20 years and not once did any of them sleep on their back....all 132 pounds of her....Yes she is now on a diet. I started to have her appointed Secretary of Veterans Affair.....But a dog dos not deserve to be calles a dumb a*&s. Well now my Congressman is involved with my saga at the BVA.....if I am shooting my self in the foot might as well see that they get all they deserve. Only da Shadow knows what evil lurks in the halls at the BVA headquaters.....Stay turned for Our Gail Sunday...I mean The trials and tribulations of a Veteran and his Claim. Just to explain "our Gail Sunday" was a soap opera my mother listened to on the radio whwn I was but a wee child....Happier times ! Thanks for your post Pete53. Rentalguy I want to take that as a compliment but after giving it some deep thinking I am of the Opinion that my golden retriever could do it with two hands errrrr I mean paws tied behind her back !!!!!! I thouht that I would entertain you guys for a while. Their antics are to say the least tragic...the trouble is I really have some damn problems with the Agent Orange used in Thailand. Yep there I said it Thailand....gee I almost feel like a Blue WAter dude.. Hope I can keep VA busy so the Blue Water Navy Guys can get their appeal together. :P :P ;) :P
  10. Well The saga goes on. Received a call today from the VARO that the BVA had requested that they (VARO) send back the letter ( sent to them June 18, 2008) from my lawyer that requested they hold the decision pending a brief. Seems that BVA sent it to the VARO instesd on acting on it by replying directly to my lawyer. VARO actually stated that the BVA admitted that they screwed up. Now I assume the brief has to be prepared thus delaying the decison ino etenity....... ;) I have no idea right now of what the H-E-double-toothpicks the BVA is doing ! Furhermore to screw things up almost anyone can do it, to really F*#K things up it takes the BVA. Smile and the whole world smiles with you, mention the VA and the whole world know why no one is smiling. :P
  11. The BVA has performed a feat unkown to Veterankind or is that mankind ? Any way they appear to reverse themseves in that an Iris query of July 6, 2008 states " Your appeal is complete and is in the final stages of review. You will be notified once a decision has been issued unless one has already been renderes upon this message". Now remember they have been saying by telephone specifically a lady called "Virginia" at the BVA that the decision had been mailed on June 18, 2008 and per my request on June 30, 2008 and one of the higher up(s) at the RO stated on June 8, 2008 he had it on good authority that a decision had been made. This is the biggest cluster f$#k I have ever seen....Okay okay I know, I must be patient !
  12. That is absoluteky correct the Unites States Air Force had computerize purchasing and records as of late 60's. System was called CIAPS which is an acronym for Computer Generate Automated Purchasing. Hell we had a computerize report at Nakhon Phanom Royal Thai Air Force Base, Thailand in 1969....I hnow I was Operations Chief for the Procurement Division.

  15. Please don't put me at the bottom....This Saga is just getting good ! Sent an IRIS July 7, 2008; received IRIS reply this afternoon July 8, 1008. Informed by answer that Claim # did not match Name. The BVA Ombudsman was correct. I corrected my inquiry and within a hour or so they replied : "Your appeal is complete and is in the final stage of review; you will be notified once a decision has been issued unless one has been rendered upon this message." Strange that BVA personnel at the BVA phone inquiry section have been telling me that a decison was mailed out on June 18, 2008 and again per my request on June 30, 2008. Then again the contact I have at the RO states that he is aware of a decision and asked me to call him Thursday July 10, 2008. Keep tuned Vetrans...Ladies an Gentlemen: I will walk you through a BVA procedure that relates to a decision that has been in the works for over 3 years and 7 months. These guys have more moves than Elvis Presley ! The beat goes on !

Well if I have shot myself in the foot at least I had a hell of a time doing it..Lawyer stated BVA called him tocay and asked for a copy of the fee agreement....thought they had this. Well I sure hope it finally is a decision in my favor....then again I would know that if they sent me a copy wouldn't I ? Strange too that a Public Control Team Supervissor at the RO called me today and asked if I had been to my mail box today.......sure am getting to someone.....I called later and told him no copy of the BVA decsion..When I pressed him he stated he would not have a copy until my file is returned from the BVA. Stated he had reason to BELIEVE that a decison had been rendered. Crystal Balls now ? Well I am low man on the totem pole after all they have blown off my Counsel, and a United States Congreemans Rep. Is going to get even bettter I am sure. I am leeping an eye on the calendar; don't intend for them to eat up too much more of my reconsideration time or appeal time to the CAVC. And the beat goes on...............
  17. Well fellow Veterans this is Day 22 in the ongoing saga with the Veterans Administration. A pubic contact supevisor at the VARO states that indeed a decsion has been sent via USPS to them from the BVA, yet I cannot get a copy or findg out whether the news is good or bad. Suppose I will blindly have to submit an appeal to the CAVC.
  18. Berta: I sent a detailed FAX to the BVA on 7 July 2008, no response yet. They told my Counsel that they had not made a decision....then again a gentleman from the VARO stated today 8 July their had been a decision but he dicn't want tosend me a copy of their copy due to a cover letter? The beat goes on..........

  20. jbassser thank you for your support! When the Government changes your whole life by poisioning you and then tells you that you can't be exposed to AO after all it was never used outside of Vietnam. That I can't even feel the VA truly believes. Yes it was Mr. Mike Fairchild the Director of the VARO. Seemed to be open and concerned......I was respectful, but I can assure all that I gor my views across..and no I was very concise and non-adversarial. You don't have to cower when you have served your country by offering up your life.
  21. Well guys i have been in this match with the Veterans Administration for almost four years and I am certainly not about to shoot myself in the foot! The FAX that I sent to the BVA was truthful, respectful, and only reiterated what I had been told by BVA employees. Perhaps if we all stopped quaking in our boots we might just get VA off their ass and on their feet. I hope you all are not intimdated and just stand on the sidelines and watch them wait for the Blue Water and Thailand Vetrans die. Treat them with respect but be willing to take chances not only for yourself but for your fellow Veterans. If all else fails there is always the CAVC. Been there, done that, got a T shirt........Just my views...nothing personal.
  22. Fellow Vets I made my trip to the Regional Office today as I said I would. I set up my red camping chair, attached my picket sign to a neatby lamp post, opened my umbrella as it was raining. I sat there for about an hour before some one came out of the RO and approcached me.....It was the Dirctor of the Regional Office himself! I proceeded to tell him of my difficulty obtaining the decision that I was informed by BVA personnel was mailed to me on 18 and 30 June 2008. I gave him a copy of a FAX that I had sent to the BVA, my Counsel, my Congressman and of course to the RO specifically to his attention. I informed him that inaccordance with United States Code ....7104 that the BVA is bound by law to give me a copy of the decision as well as my Counsel. He stated he would definitely check into the problem. Talked with on of my lawyers who stated that they had talked with the BVA and they said no decision had been made.. guess it is my word against theirs....I am getting smarter. I am putting evertything in writing starting with the FAX. Apparently my lawyer feels that I might upset the BVA! I then stated I will remin pro-active and push VA as hard as I can! They can either get onboard or get offf at the nearest stop. You cannot treat the VA with kid gloves. This a knock down no holds barred street fight! Oh by the way the name is Randall not Rob.
  23. Well Ricky if the Dog ate the chicken and had the letter for desert he well have some feathers to show for it. Seriously in accordance with 38 USC Sec. 7104 © (2) (e) "(1) After reaching a decision on a case, the Board shall promply mail a copy of its written decision to the claimant at the last know address of the claimant. (2) If the claimant has an authorized representative , the Board Shall.... (A) mail a copy of its written decision to the authorizes representative; or ( send a copy of its written decision to the the authorized representative by any means reasonably likely to provide the authorized representative with a copy of the decision within the same time a copy would be expected to reach the authorized representative if sent by first class mail. Neither I or my counsel have received a copy of stated decision. Decision was alledgedly mailed June 18. 2008. Well as I said the one way to tell if you have roaches is turn on the kitchen light.....so I going to take my trusty picket sign to the Ole Regional Office today and turn the lights on!
  24. Halo2 if you have the document on your computer do a right click with your mouse and find copy on the box that pops up ; left click on copy. Then whenyou get to the place where you want of place the copy again click right mouse button click paste on the box that pops up and walla it will be there.
