  3. What would really help is for VA to give me all my retirement pay and all my VA diability pay. Yes I know if you are rated at 40% you get zilch ! Then again if they had awarded my AO claim I would be able to forget some of my pains. Oh that's right I was stationed in Thailand @NKP on the Mekong.....silly me.....couldn' possibly have been exposed ! SORRY Senior Moment.

  5. That isone of the most lucid thoughs I have ever read!!!!!! Trouble is we are honest peons for the most and seemd like you have to be greedy and dishonest to have an organization like AIG, Bank of America.
  6. You know allen can't understand why no one has replied to the dissertation of this post. I read the article from beginning to end but I can assure you that neither the VA or the Government will read it; in fact I would bet less than 5% of hadit members will read it in total. Why? Because the attention span is just not there. Don't misunderstand it is all true but when did truth result in more VA claim approvals?
  7. I appreciate you comments. Fankly speaking the VA Hospital here in Louisville, KY is wonderful. They litterally saved my life. They check every three months for any newsign of Lymphomas. Unfortunately the other side of the VA house leaves a bitter taste on uour month. thnk you again clown..... for you encouraging comments.
  8. As I am sure most of you on hadit know I have been fighting with the VA since January 2005. I have a cancer entitled non-hodgskin's Lymphoma. The claim is based on a direct service connection basis since I served in Thailand from 1969 to 1970. I have been in the hampster wheel from the VARO to The BVA then to the CAVC then remanded to the BVA and back to the VARO once again to the BVA and now awaiting a re-consideration from the BVA. I was granted an advancement on the docket due to the seriousness of the disease. Main question I have: is the BVA bound by the previously granted advancement on the docket in respect to a re-consideration request. I sure hope someone out there can tell me because the VA sure won't.

  10. I have been reading many posts since I joined HadIt; I have been tying to get direct service connection for NHL for four years . It were to be awarded my claim with say 100% diability today; and one year down the road I find the cancer has reocurred I assume that I will have to file another claim for the same condition. The system operates so slowly I dont't think that many cancer patients would survice any kind of claim time. Keep seeing on this board if cancer is in remission the Vet should not receive compensation. I beg to differ. The hell that expoxure to Agent Orange and the many cancers caused by it should be compensated at some rate other than 0% even if it were in remission. Perhaps the VA has a graduated system that now allows the rate to fluctuate as to in remission or not in remission.. Anyone have any input?

  12. You can obtain legal representation (laywer) from day one and the fee is no more than 20% of the retro.

  14. Yes he was a lousy DAV rep 10 years ago and a lousy Supervisor for DAV. I really don't understand why the VA is so vigilant when it comes to VA Claims but has no audit procedures to stop this. If HR 6562 were passed it would benefit a lot of AO Veterans and provide VA a well deserved kick in the ASS !
  15. I sincerely hope that no one takes offense at the topic title; I will not try to talk for all AO veterans but for myself alone. The government, Veterans Administration, and now Hadit! have all relagated AO veterans to the back page, no longer worthy to discuss.. Don't believe it? Look at for the "AO FORUM" on Hadit! It is at the bottom of the introductory scree on Hadit! H.R. Bill 6562 pertaning to allowing all AO veterans exposed to Agent Orange to HAVE BEEN EXPOSED TO AGENT ORANE if they received the Vietnam Service Metal. This is the time to place the spolight on the AO problem not send it to the bottom of the page i.e. bury it like VA!
  16. Berta just a short memo : 1. I referenced 0ne direct buddy letter and at least four letters that cited use before and after I was there. Of course I used Preismman's Checo report and the Air Force letter to Senator Layne Evans. I developed NHL, Hypertension, problems with my left eye, had a heart operation in July due to a clot the size of a thumb. (This was the result of an implanted in my upper left chest; the probe caused the clot.) I am going to let Karl proceed to the CAVC; but unfortunately only GOD could win this one.....Yes I am from Louisville, Kentucky where the SOB Parker was a supervisor for the DAV....I did one thing right a few years ago , I fired them.   17. Berta I have to file the Notice of Appeal to the CAVC;have approximately 47days.....brief is no rush at this time. Berta I am presently represented by Karl Kazmierczak of Oakland, New Jersey. I wish I could be sure of his desire to really want to process this claim with all deligence. He appears tentative. I am preparing myself to file pro se if I have to.   18. I need a copy of a brief that anyone has prepared for the United States Court of Appeals For Veterans Claims. I have a copy of how to do it from the CAVC but a working layman copy would be of immense help.
  19. Berta I have been trying for almost four years to receive an award based on exposure to agent orange. I have submitted buddy letters, a 1999 decision in which the BVA awarded a Veteran 100% disability based on exposure to Agent Orange. The Clincher is we were both stationed in Thailand from august 1969 to Augsust 1970. While the case is non precentent the CAVC told the BVA on remand that based on the fact that the place, time, and circumstances were so similar that they had to tell me why if they rule against me on material facts of the 1999 case. Their recent decision which was negative failed to address that decision. I have had the same Acting Veteran law judge "D. Reiss" since the initial board hearing. Yes I did present Kurt's recent Checo report attesting to the presence of agent Orange and in addition the letter that the Air Force sent to Senator Lane Evans. Plan to submit a request for reconsideration. I will be able to recluse "D. Reiss" from anothe decisoion and have three veteran law judge review my case denovo. If this fails I will once again appeal to the CAVC who was critical of the BVA on my last turn of the hampster wheel. Have Karl Kazmierczak as Counsel. My MOS or AFSC in the Air Force was 65190 Contracing Speicalist and that encopasses construction contracts and the periodic oon site inspections of those projects. That placed me on the Base Perimeter where Agent Orange was sprayed.
  20. I cannot state it any clearer than MSGT Preiessman stated in a previously classified CHECO report. That report states AO was available and utilized for perimeter defense at all Thailand installations and a letter from the Air Force and Senator lane Evans futher enforced this use....Damn it people we have already won on AO get off your ass and picket your VARO(s) and let your senators and Representatives know.... I am in an AO fight with VA for a period going on four years and I am not about to giveup. I will let my lawyer do the things he does while I do what I do and that is Picket.

  23. Berta I know you are a very busy lady but I need help from a person who knows the BVA. I was just denied by the BVA for the second time. I have presented buddy statements; a letter from the Air Force to Congressman Layne Evans (cites that Base Commanders in Thailand were at liberty to use hebicides); excerpts of the recently declassified CHECO report and still deny...deny...deny... suppose my claim for non-hogkins lymphoma is not enough so perhaps I can claim my open heart surgery July 21, 2008; caused by an implanted port probe..... Just need you views and what confidence you have in a Mr. Karl Kazmierczak of Oakland, NJ. Thank everone on Had it for I have truly have had it !!!!!!!

I never thoght of myself as an obstructionist; then again I never buy a half loaf of bread either.. I am proudly from the state of Kenucky and our state flag is embroiderd with the motto "UNITED WE STAND,DIVIDED WE FALL". We must all stand together for the common good.....   25. THANK YOU VETS ! SO FAR I HAVE HAD FOLLICULAR LYMPHOMA (CANCER) IN 2003 AND JUST HAD A HEART OPERATION 22 JULY 2008 TO REMOVE A CLOT CAUSED BY A PORT IMPLANT. CLOT WAS THE SIZE OF A THUMB. QUIT ? HELL N0! SURRENDER ? DON'T KNOW THE MEANING ! ATTACK, ATTACK, NEVER LET THEM SEE YOU SWEAT.
