That is a good idea; I have a United States Court of Appeals for Veterans Claim Notice of Appeal on my desk now already to fill out and to submit via cerified mail, return receipt .I'll get out my picket sign that I have used previously, might I say with positive results, and drive to the VARO; picket them again and see if anyone there will help me....they do not feel comforatble with a picketer at their front door. I have of course told them via recorded phone messages of my inability to get a mail copy of the BVA decision with no call back. So I'ee take the gloves off and we will play hardball. ATTN: jbasser: If you have a direct contact telephone number for Mike Fairchild, Director, Louisville, VARO send it to me.
  2. I do not have a SO. Have myself, Lawyer,and Congressman's Aide. I called 5 times, Lawyer has no receipt, Congressman's Aide called and is waiting for a call bck. Lke a srong wind the have blown us all off! BVA states decision on 18 June, 2008; today is 5 July, 2008 a total of seventeen days.,,,,patience hell !
  3. Well I have seen a lot since January 2005, but never thought I would have the problem of convincing the Board of Veteran Appeals that I never received a mailed copy of their decision. Have repeatedly informed BVA of non receipt on at least four occasions. They assured me that they sent it to my Post Office Box...even read the correct number back to me, correct city, state, and zip code...of course the BVA cannot prove they sent it and for that matter they cannot confirm I received the decision ( which I did not). It will be 17 days from June 18, 2008 to Saturday Joly 5, 2008. Sent the decison via regular first class mail. They did agree to send a second copy on June 29, 2008. To date second copy has not been received (and the first copy must be lost, stolen, destroyed or heavens, perhaps they never sent it? Tell me it ain't so oh great Secretay of the Department Of Veterans' Affairs....General Peake. I have invoked great guns to blast them from their reticent actions to include invoking the rath of God, little Ole Me, My Counsel, and even my Congressman.....The mighty winds of the VA blew us all off. Then again who do I think I am >>>>after all they failded even to yet respond to a United States Congressman!

  10. The Acting Veternas Law Judge's name is D. Reiss. Someone is taking him seriously since he has caused numerous denials and delays. I really need to know if I can request a change.
  11. I hope some one on the site can help me. I have an AO case that has been to the RO, BVA, CAVC, and back to the CAVC, THE RO and is now on its was back to the BVA (UNDER REMAND). I have had the same Acting Veterans Law Judge from the initial travel board meeeting to the BVA (twice). Is there a way to get away from this Veterans Law Judge and perhaps get a fresh start from a new VLJ?
  12. Just found out from our local news that he was also 107. according to Wikepedia his correct name is Robey H. Rex , Born 4 May 1901 Age 107. some dispute when he signed up 1918 or 1919, Frank Buckles "Woodruff" born 1 February 1901 Wikipedia states Last US Veteran. He served overseas and resides in Charlestown, West virginia. Larry J. you can be proud of this heroe "Frank Buckles". Correct me if info is incorrect.
  13. We have a gentelman here at Louisville, Kentucky who for many years volunteered at the VA hospitlal. He is now in a nursing home but at last I knew he was well over 100 years old. Understand he never went overseas but had finished his training before WW1 ended. Will try to get his exact age. Gentleman's name was Rex Roby or Robie not sure of the spelling of his last name..

  15. May I humbly suggest thst you have a sign made by a professional sign maker stating exactly what your grievances are. Take this sign along with a comfortable camping chair, umbrella to ward off the suns rays, and place these items and your body (with sign) in front of their door. You must of course stay on the public right of way and check with your local government if you require any type of permit. I will guarantee you that within a few hours they will come to you to see what you need. These "Government Servants" do not like lights to be turned on where everyone can see them for what they are. It works......I personally did it. Gets rsults.

  17. Berta I just want to thank you for your mention of Karl Kazmierczak. He is a fresh breath of air after do nothig lawyers i.e. Liebeman & Mark. A good law firm is like finding a gold nugget.
  18. I would laugh about it but 50 million would go a long way in taking care of our Veterans that are homeless, sick, and getting royally screwed. Peronslly I have an AO claim that has been going in circles for over 1,260 days! It is a race to see if I die first or the VA gives me an affirmantive decision on my claim! Guess who is going to win......... Our economy is in the toilet Washingto and DOD are using Stop Loss as a back door daraft The Air Force has to reduce its numbers by 10,00 this year despite a shortage of manning in other branches VA has a back log of over 600,000 claims The dollar is not worth a continental (hey that's funny) Gas prices at at all time highs due to futures traders on the New York Stock Exchange The only way we have to go is up.......... If a country ever needed leadership and common sense this one does.
  19. Wings, this is not a motion of reconsideration but a remand comming back from the RO to the BVA. Hope that this applies to a remand also. Have read 38 U.SC.......but the legalize is maddening. Regards Randall

Does anyone know why a Veteran has to have the same Veteran Law Judge at th inital hearing, then the same Veteran Law jugde renders the initial claim decision at the BVA plus on remand he controls the remanded Claim back to the VARO. How do I get a different Veteran Law Judge on return from the VARO TO THE BVA ? Is there a rgulation, rule, or law on this?
  21. I would first call 911. The imediate idea is to get him into a hospital any hospital and damn the cost; ERs have to take him. Let the Civilian hospital argue with the VA. The second thing after you assure he is getting heip...again damn the cost...is to inform the news outlets in your area. Contact Social Security even if he is not 65.....a good social worker or pro bono lawyer could get him SSI. If he is a Veteran apply enough pressure to shove his care down VA's proverbial throats.
  22. Berta I have forwarded everything I have on my remanded claim plus my C file to Mr. Karl Kazmierczak of Oakland, NJ. I believe you mentioned him in one of your posts. Hope he can get up to speed before the RO sends my remanded claim back to the BVA. I have refuted their denial of Agent Orange at Nakhon Phanom Thailand via unclassified Checo reports; personal e-mails and buddy letters with the pejury statement. I have proof that Ranch Hand UC123-K aircraft were stationed at NKP. Have proof that an attack on NKP occurred at the base by communist sympathizers. I almost feel like I live in the NAZI Germany era where a lie became the truth if the lie was repeated until all believed it was the truth. Since my receipt of my SSOC on 14 March 2008 I have sent new and material evicence countering every negative statement in the local RO's SSOC. Is there a way I can formally request a re-consideration to receive a ruling by the RO prior return of remanded claim to the BVA. The BVA gave the RO this option. Seems like Thailand an Agent Orange is a hot potato. Sorry Jim if I sounded cranky but this is very important to me...hope you will forgive me. Perhaps by an extraordinary relief request? Of course I will counsel with Mr. Kazmierczak before such a move. Regards Randall

  24. Berta the sad part about this firm is that one on the partners Kathy A. Lieberman is the NOVA treasurer! I personally called NOVA and told them of my low opinion of this lawyer. It just Galls me that NOVA of all organizations would have this firm and lawyer as a member...let alone the Treasure and a Board Director! Is there any justice in this world....guess not when the insane are running the asylum! Look this up on www.vetadvocates.com the NOVA site URL.
  25. I agree with you. I have had depression for my entire life. You must fight it tooth and nail. I find that taking one 100 milligram tablet of sertraline a day makes my living with depression a whole lot better. Of course VA would depress anyone. hang in there buddy we are all rooting for you and you are not alone. Randall
